WJM&L:PDA:S:zw 3/" 75 ]0c RESOLUTION NO. 696-D A RESOLUTION OF INTENTION TO MAKE CHANGES AND MODIFICATIONS VILLAGE PARKING DISTRICT NO. 2 RESOLVED, by the City Council of the City of Saratoga, that Resolution of Intention No. 696-C to Acquire and Construct Improve- ments and to Form Village Parking District No. 2 Maintenance District, adopted by this Council on June 5, 197~, be, and the same is hereby changed and modified as follows: 1. Change and modify the description of the acquisitions and improvements, as follows: "l(a) The acquisition of the property, more particularly scribed in Exhibit "A" hereto attached and by reference incorporated herein, and the improvement thereof by Clearing, grubbing, grading, removal of existing trees, shrubs and structures, where required, and the construction therein of base, pavement, wearing surface, curbs, gutters, surface and subsurface storm drainage facilities, where ~equired, lighting facilities, striping, driveway approaches, and landscaping, including irrigation facilities together with all work auxiliary to any of the above and necessary to complete the same as off-street automobile parking facilities. (b) The improvement of the southerly side of Big Basin Way, Fourth Street and Fifth Street within the limits of the proposed assessment district as shown on that certain map entitled 'Village Parking District No. 2, City of Saratoga' dated March, 1975, on file in the office of the City Clerk, by the construction and/or recon- struction, as required, to meet the standards of the City of Saratoga, of curb cuts, driveways, sidewalks, curbs, gutters, pavement, sur- face and subsurface storm drainage facilities and underground electrical transmission and distribution facilities and communication facilities together with appurtenances to any of the above. (c) The acquisition of at! lands and easements and the performing of all work auxiliary to any of the above and necessary to complete the same." 2. Change and modify Section 14 of said Resolution of intention to read as follows: "14. Said contemplated acquisitions and improvements, in the opinion of said Council, are of more than local or ordinary public benefit, and the costs and expenses thereof are made chargeable upon as assessment district, the exterior boundaries of which district are the composite and consolidated area as more particularly shown on a map thereof entitled 'Village Parking District No. 2, City of Saratoga'., dated March, 1975, prepared by the Department of Public Works of the City of Saratoga and on file in the office of the City Clerk. Said map indicates by a boundary line the extent of the territory included in the proposed district and shall govern for all details as to the extent of the assessment district." 3- Change and modify Section 16 of said Resolution of Intention to read as follows: "16. Notice is hereby given that serial bonds to represent the unpaid assessments, and bear interest at the rate of not to exceed eight percent (8%) per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of 1915, Division 10 of the Streets and Highways Code, the last installment of which bonds shall mature not to exceed fourteen (14) years from the second day of July next succeeding ten (10) months ~om their date." 4. Change and modify Section 17 of said Resolution of Intention to read as follows: "17. Notice is further given that should there be publicly owned operative property within the assessment'district, certificates or serial bonds to represent the unpaid assessments against publicly owned property in use in the performance of a public function and bear interest at the rate of not to exceed eight percent (8%) per annum, will be issued hereunder pursuant to Section 6467 or Chapter 4.5 (commencing with Section 6468), Part 5, Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, the last installment of which certificates or bonds shall mature not to exceed fourteen (14) years from the second day of June beginning with the fiscal year next following the date of the bonds." 5o Change and modify Exhibit "B" describing boundaries of the City of Saratoga Village Parking District No. 2 Maintenance District to read as set forth in said Exhibit "B" hereto attached and made a ~art hereof. NOTI'CE IS HEREBY GIVEN that Tuesday, the ~th day of April, 1975, at the hour of 8:00 o'clock P.M. in the regular meeting place of 2 said Council, Council Chambers, City Hall, Saratoga, California, are hereby fixed as the time and place when and where said Council wilt consider the matter of making said changes and modifications and hearing all protests and persons interested therein. The Clerk of said City shall cause a copy of this resolution to be published once in the Saratoga News, a newspaper of general circulation published in said City, and to be mailed to all property owners in the proposed assessment district, said publication to be at least ten days before said day of hearing, and said mailing to be at least 20 days prior to said hearing date.
