HomeMy WebLinkAboutCity Council Resolution 718 RESOLUTION NO. 7 ] 8 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING A SPECIAL MAXIMUM PROPERTY TAX RATE ELECTION AND REQUESTING THE BOARD OF SUPERVISORS OF SANTA CLARA COU~Y TO PROVIDE THE SERVICES OF THE REGISTRAR OF VOTERS FOR A MAILED BALLOT SPECIAL ELECTION ON MARCH 4, 1975 WHEREASs the City Council of the City of Saratoga has been requested by Saratoga Manor Homeowners Association to call a special election to approve an increase in the maximum property tax rate to $.28 (twenty-eight cents) per $100.00 of assessed valuation for the Manor Drive Park Maintenance District; and WHEREAS, the Council finds that there are 250 or fewer qualified voters eligible to vote in the Manor Drive Park Maintenance District; and WHEREAS, the Council finds that consolidation with any other election on March 4, 1975 would be impracticable because said Park Maintenance District has too few voters and the use of mailed ballots is much more efficient and economical in this instance than the usual procedures that are adhered to in a consolidated election with formal polling places; NOW, THEREFORE, BE IT RESOLVED by the City Council of Saratoga, as follows: Section 1: A special maximum property tax rate election is hereby called to be held in Manor Drive Park Maintenance District on Tuesday, March 4, 1975, at which election shall be submitted to the qualified electors of the District the following measure, to wit: Measure ( ): Shall a proposed increase to $.28 (twenty-eight cents) per $100.00 of assessed valuation in the maximum property tax rate, such rate to be the maximum authorized tax rate in the Manor Drive Park Maintenance District commencing in fiscal year 1975-76, be approved? Yes No Section 2: The Council finds, in accordance with Section 2286 of the Revenue and...TaXat~0n.code~.that.the ManOr Drive Park Maint- enance District is a local agency that was in existence on AugUSe 31, 1973, which desires to change its maximum property tax rate and has requested said Council to call a special election to approve a new maximum property tax rate for said District. Section 3: The Council requests, in conformance with the provisions of Sections 2287 and 2288 of the Revenue and Taxation Code that the Board of Supervisors of the County of Santa Clara provide for the use of mailed ballots in said special election. Council further requests that there shall be no polling place for said election, and that qualified voters shall vote by absent voter ballots or vote at the office of the Registrar of Voters of the County of Santa Clara on election day. Section 4: The Board of Supervisors of the County of Santa Clara is hereby requested to permit the County Registrar of Voters to render the following services required by law for the conduct of the Manor Drive Park Maintenance District maximum property tax rate election in the City of Saratoga: (a) Preparation of precinct registration listing (b) Preparation of indexes (c) Preparation of ballots and arguments on the measure Section 5: Said Board of Supervisors of the County is hereby further authorized to canvass, or cause to be canvassed, as provided by law, the returns of said special election with respect to the votes cast on said measure and to certify such canvass of the votes cast for and against said measure to the Council. Section 6: The City of Saratoga shall pay to the County of Santa Clara the actual cost of said services, such payment shall be made when all of the same are completed and upon presentation to the City of Saratoga a properly approved bill from the Councy. Section 7: The City Clerk of the City of Saratoga is hereby authorized and directed to do any and all acts, including the entering into any contract or contracts with the County of Santa Clara as may be necessary, in order to carry out the terms of this resolution. The above and foregoing resolution was regularly introduced and thereafter passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the ]8th day of D~cember , 1974, by the following vote: AYES: Bridges, Brigham, Kraus and Diridon NOES: None ABSENT: None .~~ , ..../ ....
