HomeMy WebLinkAboutCity Council Resolution 769 CITY OF SARATOGA RESOLUTION NO. 769 RESOLUTION REQUESTING THE BOARD OF SUPERVISORS OF SANTA CLARA COUNTY- TO PROVIDE FOR THE CONSOLIDATION OF A SPECIAL MUNICIPAL BOND ELECTION AND A SPECIAL MUNICIPAL ELECTION WITH THF STATE OF CALIFORNIA DIRECT PRIMARY ELECTION TO BE tlELD ON JUNE 8, 1976 WHEREAS, the City Council of the City of Saratoga proposes to adopt an ordinance calling a special municipal bond election to be held in the City of Saratoga on Tuesday, June 8, 1976, at which election will be submitted to the oualified electors of the City the following measure, to wit: MEASURE ( ): Shall the City of (Park and Recreation Saratoga incur a Facilities) bonded indebtedness in the principal amount of $2,000,000 for the acquisition of the following municiDal improvement, to wit: Park and recreation ~acilities, comprising the acquisition of approximately 400 acres of land located in the Saratoga hillside area for open space mreservation, generaliv being a portion Of those lands in and about the western foothills of Saratoga from Hakone Gardens north to the Parker Ranch? AND ~{EREAS, the City Council of the City of Saratoga has adopted a resolution calling a special municipal election to be held in the City of Saratoga on Tuesday, June 8, 1976, at which election will be st~bmitted to the oualified electors of the City the following measure, to wit: MEASURE ( ): Shall the maximum (Maximum T~x Rate tax rate of the Increase) City of Saratoga be increased by One Dollar Thirty Cents ($1.30) for each One Hundred Dollars ($100) of assessed valuation of all taxable Droperty within the City, such increased rate to be in effect either for Fiscal Year 1976-1977 or Fiscal Year 1977-1978, the revenues of which are to be used to acquire aDproxi- mately 400 acres of land located in the Saratoga hillside area for open space Dreservation, generally being a portion of those lands in and about the western foot- hills of Saratoga from Hakone Gardens north to the Parker Ranch? AND WHEREAS, a State of California Direct Primary Election will be held on Tuesday, June 8, 1976, and it is the desire of the Council that both of said special municipal elections be consolidated with said Direct Primary Election; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga, as follows: Section 1. The Board of Supervisors of Santa Clara County is hereby requested to order the consolidation of both of said special municipal elections with said Direct Primary Election to be held on Tuesday, June 8, 1976, insofar as the City is concerned, and to further provide that within the territory affected by said order of consolidation, to wit, the City, the election precincts, polling Dlaces and voting booths shall in every case be the same and there shall be only one set of election officers in each of said precincts, and to further provide that said measure for incurring bonded indebt- edness hereinabove set forth and said measure for a maximum tax rate increase hereinabove set forth shall be set forth in each form of ballot to be used at said election insofar as the same is held within the City. The Board of Supervisors of Santa Clara County is further requested to order the Registrar of Voters of the County (i) to set forth on all samDle ballots relating to said consolidated elections, to be mailed to the qualified electors of the City, said two measures hereinabove set forth, and to mail with said sample ballots to said electors printed copies of arguments (if any) for and against said measures, and a copy of the tax rate statement for said bond measure, and (ii) to provide absent voter ballots for said Direct Primary Election and said special municipal elections consolidated therewith for use by qualified electors of the City who are entitled thereto, in the manner provided by law. Section 2. The Registrar of Voters of Santa Clara County is hereby further authorized to canvass, as provided by law, the returns of said special municipal elections with respect to the votes cast on each of said measures and to certify such canvass of the votes cast for and against each of said measures to the Council. Section 3. The City Clerk is hereby authorized and directed to certify to the due adoption of this resolution and to transmit a copy hereof so certified to the Board of Super- visors of the County and to file copies hereof so certified with the County Clerk of the County and with the Registrar of Voters of the County PASSED AND ADOPTED March 23, 1976, by the following vote: AYES: Councilmen Bridges, Kraus, Brigham, Corr, Matteoni NOES: None Mayor of the City 0f~Sara~a c] 3
