Home My WebLink AboutCity Council Resolution 877 RESOLUTION NO. 877 RESOLUTION ESTABLISHING CRITERIA FOR MODIFIED CONDITIONS OF SITE APPROVAL -- SECTION 27, ORDINANCE NS-60. The City Council of the City Of Saratoga hereby resolves as follows: As a matter of policy to be followedby the Land Develop- ment Committee in conditioning applications for minor site approval of single lots or parcels not involving a division of land, under Section 27 of Ordinance NS-60, until such time as modified or changed by ordinance or resolution of this Council, the following criteria are hereby established for guidance of said Committee: 1. Where the site approval is required by reason of the addition to or expansion of a main structure increasing the floor space under roof by 50% or more (see Section 21(c)(1), neither storm drainage fees nor Park and Recreational fees shall be charged. 2. Where the lot or site fronts on one of the streets listed in Appendix A to this resolution, and as said list of streets may from time to time be amended, if public s~reet improvements are required, they may be required under a standard form Deferred Improvement Agreement. 3. Where the following conditions all exist, to-wit: (a) The site is approved for a septic sewage disposal system by the County Health Department, and (b) The closest existing sanitary sewer main is more than 300 ft. from the perimeter of the lot or parcel at its closest point, and (c) The owner/applicant executes an agreement with the City to participate in a Sewer Assessment District of the area if requested, and in any and all events to connect to any sewer main that is extended to within 300 ft. of the boundaries of said lot or parcel, then connection of said parcel to a sanitary sewer shall not be required as a condition of site approval, and septic tank disposal shall be permitted. The above and foregoing resolution was regularly introduced and adopted by the City Council of the City of -1- Saratoga at a regular meeting thereof held on the 1st day of Novembe_r' ~, 1978 by the following vote:
