RESOLUTION NO. 888-A
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPBEIAL ASSESSMENT AND ASSESSMENT
BOND ACTS FOR THE ACQUISITION OF IMPROVEMENTS
WITHOUT PROCEEDINGS UNDER DIVISION 4
OF THE STREETS AND HIGHWAYS CODE
VILLAGE PARKING DISTRICT NO. 2
ASSESSMENT DISTRICT
RESOLVED, by the Council of the City of Saratoga, California,
that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed with
the City Clerk of this City a written petition for undertaking
proceedings pursuant to special assessment and assessment bond acts,
and to assess the costs thereof upon the properties benefited by
said improvements, and waiving proceedings under Division 4 of the
Streets and Highways Code of the State of California, for the
acquisitions more particularly described in Exhibit "A" hereto
attached and by reference incorporated herein;
WHEREAS, the costs and expenses of said contemplated
acquisitions are to be chargeable upon an assessment district, the
exterior boundaries of which are the coterminous exterior boundaries
of the composite and consolidated area shown on a map thereof
entitled "Proposed Boundaries of Village Parking District No. 2
Assessment District", on file in the office of the City Clerk, to
which reference is hereby made for further particulars; and
WHEREAS, the public interest and convenience will be served by
the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED
that all of the owners of more than 60% in area of the property
subject to assessment for said proposed acquisitions have filed with
the City Clerk of this City a written petition for the acquisition
of improvements pursuant to appropriate special assessment and
assessment bond acts, without further compliance with the provisions
of Division 4 of the Streets and Highways Code.
IT IS FURT}{ER FOUND, DETERMINED and ORDERED that said
proceedings for the acquisition of said improvements shall be had
pursuant to the Municipal Improvement Act of 1913, Division 12 of
said Streets and nighways Code, and the bonds upon the unpaid
assessments thereof shall be issued pursuant to the Improvement Bond
Act of 1915.
IT IS FURTHER FOUND, DETERMINED and ORDERED that the provisions
of Division 4 of the Streets and Highways Code be, and they are
hereby dispensed with.
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the 3rd day of January, 1979, by the following vote of the
members thereof:

a) The acquisition of that certain real property situate in the
City of Saratoga, County of Santa Clara, State of California,
more particularly described as follows:
Beginning atthe point of intersection of the southeasterly
line of Big Basin Way with the northeasterly line of Fifth
Street, and running thence South 46o31' East 95.00 feet to
the TRUE POINT OF BEGINNING; thence North 43000' East 204.26
feet, more or less, to the southwesterly line of Lot 2 of
Block 7, as shown upon the Map entitled "PLAN OF THE TOWN OF
McCARTYSVILLE IN SANTA CLARA COUNTY" filed on September 28,

SUBJECT: Village Parking District No. 2
Dear Mr. Shook:
We are pleased to submit this proposal for engineering
services on Subject Project located on Big Basin Way between
Fourth and Fifth Streets in accordance with the following
schedule:
SCOPE OF WORK AND COMPENSATION
1. Prepare Engineer's Report to include Assessment Diagram,
Proposed Boundaries Map and all related exhibits.
2. Prepare Parcel Map for land division.
Above work to be performed for Lump Sum of: $ 2,400.00
If this proposal is acceptable, please sign one copy, and return
it to this office in lieu of a formal contract. It is understood
that payment shall be made by the City solely from assessment
district proceedings and sale of assessment bonds in said pro-
ceedings and not otherwise and there shall be no liability upon the
City of Saratoga to make payment from any other source of funds.
