HomeMy WebLinkAboutCity Council Resolution 888-E1766A. 83a WMAM:PDA:nmd 12/1~/78 12c RESOLUTION NO. 888-E A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT VILLAGE PARKING DISTRICT NO. 2 ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of Saratoga, California, that WHEREAS, on the 3rd day of January, 1979, said Council did adopt its Resolution of Intention No. 888-D , to acquire improvements in said City, and did refer the proposed acquisitions to the Engineer of Work, he being the officer having charge and control of the acquisitions and construction of public improvements in and for said City of the kind described therein and being a competent person employed by said City for that purpose, and did therein direct said Engineer of Work to make and file with the City Clerk of said City, a report in writing all as therein more particularly described, under and pursuant to the Municipal Improvement Act of 1913, Division 12 of the Streets and Highways Code of the State of California; WHEREAS, said Engineer of Work has made and filed with the City Clerk of said City a report, in writing, as called for in said Resolution of Intention and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that neither said report, nor any part thereof requires or should be modified in any respect; NOW, THEREFORE, IT IS ORDERED, as follows: 1. That the plans and specifications for the proposed improvements to be made, contained in said report, be, and they are hereby preliminarily approved. 2. That the Engineer's estimate of the itemized and total costs and expenses of said acquisitions and of the incidental expenses in connection therewith, contained in said report, be, and each of them are hereby, preliminarily approved. 3. That the diagram showing the assessment district referred to and described in said Resolution of Intention and also the boundaries and dimensions of the respective subdivisions of land within said assessment district as the same existed at the time of the passage of said Resolution of Intention each of which subdivisions has been given a separate number upon said diagram, as contained in said report, be, and it is hereby, preliminarily approved. 4. That the proposed assessments upon the several subdivisions of land in said assessment district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said acquisitions and of the incidental expenses thereof, as contained in said report, be, and they are hereby, preliminarily approved. 5. That the maps and descriptions of the lands and easements to be acquired, as contained in said report, be, and the same are hereby, preliminarily approved. 6. That said report shall stand as the Engineer's Report for the purposes of all subsequent proceedings had pursuant to said Resolution of Intention. -2- I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the 3rd day of January, 1979, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Councilmen Kalb, Ma~teon~ Ca~lon, Kraus& Corr NOES, Councilmen: None ABSENT, Councilmen: None City Cle~o~ t~(~St~L~f Saratoga APPR VED: -3-
