WMAM:PDA:rva 10/1~/'/9 12c RESOLUTION NO. 889-E A RESOLUTION AMENDING RESOLUTION NO. 889-C ENTITLED, "A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS" VILLAGE PARKING DISTRICT NO. 4 ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of Saratoga, California, that Resolution No. 889-C entitled "A Resolution of Intention to Acquire and Construct Improvements", adopted by this Council on February 7, 1979, be, and the same is hereby, amended as follows: 1. That the description of the work to be done, acquisitions and improvements to be made as more particularly described in said resolution be amended to read as set forth in Exhibit "A" hereto attached and by reference incorporated herein. 2. That Section 11 of said resolution be amended to read as follows: "11. Said contemplated acquisitions and improvements, in the opinion of said Council, are of more than local or ordinary public benefit, and the costs and expenses thereof. are made chargeable upon an assessment district, the exterior boundaries of which district are the composite and consolidated area as more particularly shown on a map thereof entitled "Proposed Boundary, Village Parking District No. 4, City of Saratoga, Santa Clara County, State of California", dated July, 1979, and on file in the office of the City Clerk to which reference is hereby made for further particulars. Said map indicates by a boundary line the extent of the territory included in the proposed district and shall govern for all details as to the extent of the assessment district." 3. That Section 20 be added to said resolution to read as follows: "20. The total estimated cost of said project is $528,500.00." 4. That Section 21 be added to said resolution to read as follows: "21. That, pursuant to Part 14 of Division 10 of said Streets and Highways Code, said Council intends to covenant for the benefit of bondholders to commence and diligently prosecute to completion any foreclosure action regarding delinquent installments of any assessments which secure the bonds to be issued in said proceedings to represent unpaid assessments," 5. That Section 22 be added to said resolution to read as follows: "22. That, pursuant to Part 16 of Division 10 of said Streets and Highways Code, said Council intends to include in said proceedings an amount to create a special reserve fund for the bonds to be issued in said proceedings to represent unpaid assessments." I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the 7th day of November, 1979, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Kalb, Matteoni, Callon,Kraus & Corr NOES, Councilmen: None ABSENT, Councilmen: None City Clerk of of Saratoga (SEAL) For -2- 1872A-87a EXHIBIT "A" a) The acquisition of that certain real property situate in the City of Saratoga, County of Santa Clara, State of California, more particularly described as follows: Lands to be acquired by the City of Saratoga, County of Santa Clara, State of California for Parking District No. 4. BEGINNING at the Southwesterly corner of Lot 10, Block 6, as said corner is shown upon the map of "Town of McCartysville" said map filed in the Office of the Recorder of the County of Santa Clara, State of California on September 28, 1870, in Book "A" of Maps at Page 43, said corner also being on the Northerly line of Oak Street; thence North 47o 00' 00" West 98.00 feet to the TRUE POINT OF BEGINNING: South 430 00' 00" West 100.00 feet; thence South 47o 00' 00" East 23.00 feet; thence, South 43o 00' 00" West 50.00 feet to a point on the Easterly line of Fourth Street; thence along said Easterly line North 47© 00' 00" West 135.00 feet; thence leaving said line North 43o 00' 00" East 220.00 feet; thence South 47° 00' 00" East 29.00 feet; thence North 43° 00' 00" East 80.00 feet to a point on the Westerly line of Third Street; thence along said Westerly line South 47o 00' 00" East 24.00 feet thence leaving said line South 43o 00' 00" West 100.00 feet; thence South 47© 00' 00" East 13.00 feet; thence South 43o 00' 00" West 50.00 feet; thence South 47© 00' 00" East 46.00 feet to the TRUE POINT OF BEGINNING. Said parcel containing 24230.00 feet or 0.556 acres of land. and the improvement thereof by clearing, grubbing, excavation, grading, removal of existing trees, shrubs and structures and construction therein of base, pavement, curbs, gutters, sidewalks, surface and subsurface storm drainage facilities, where required, lighting facilities, wheel stops, striping, signing, driveway approaches, and landscaping, including irrigation facilities, together with all work auxiliary to any of the above and necessary to complete the same as off-street parking facilities. b) The construction of a sanitary sewer main and manholes with manhole frames and covers from an existing sanitary sewer manhole in Third Street 200 feet, more or less, northwesterly of the centerline of Oak Street running thence southwesterly and generally parallel to Oak Street 120 feet, more or less, thence generally southerly 125 feet, more or less, thence southwesterly and generally parallel to Oak Street 50 feet, more or less, to the most northerly corner of Assessor's Parcel Number 517-9-35. c) The acquisition of a right of service and use in the sanitary sewerage and sewage disposal facilities of County Sanitation District No. 4 of Santa Clara County. d) The acquisition of all lands and easements, disposal and other rights, and the performing of all work and the construction of all improvements auxiliary to any of the above and necessary to complete the same.
