RESOLUTION CONFIRHING CANVASS BY THE REGISTRAR OF
VOTERS OF SANTA CLARA COUNTY OF SPECIAL
HUNICIPAL ELECTION CONSOLIDATED HITH THE STATE
OF CALIFORNIA SPECIAL 12th SENATE
DISTRICT ELECTION AND GENERAL tIDNICIPAL ELECTION
The City Council of the City of Saratoga hereby resolves as
follows:
WHEREAS, a General Municipal Election was held in the City of
Saratoga on Tuesday, the 8th day of April, 1980, and was conducted
in the form and manner as required by the laws of the State of California
governing the election of General Law Cities, now therefore,
BE IT RESOLVED, DETERMINED AND DECLARED as follows:
That in Precinct 4676 being a consolidation of Precincts 4676 and
4682; Precinct 4677, being a consolidation of Precincts 4677, 4678 and
4679; Precinct 4680, being a consolidation of Precinct 4680 and 4710;
Precinct 4681, being a consolidation of Precincts 4681 and 4711;
Precinct 4683, being a consolidation 4683 and 4686; Precinct 4684;
Precinct 4685, being a consolidation of Precincts 4685 and 4693,
Precinct 4687, being a consolidation of Precinct 4687 and 4726; Precinct
4688, being a consolidation of Precincts 4688 and 4706; Precinct 4689;
Precinct 4690, being a consolidation of Precincts 4690 and 4691; Precinct
4692, being a consolidation of Precincts L¡·692 , 4694 and 4716; Precinct
4695, being a consolidation of Precinct 4695 and 4725; Precinct 4696,
being a consolidation of Precincts 4696 and 4708; Precinct 4697, being a
consolidation of Precincts 4697 and 4715; Precinct 4698, being a consoli-
dation of Precincts 4698, 4704, 4709 and 4729; Precinct 4699, being a
consolidation of Precincts 4699 and 4712; Precinct 4701, being a consoli-
dation of Precincts 4701 and 4723, Precinct 4702, being a consolidation of
Precincts 4702 and 4705; Precinct 4703, being a consolidation of Precincts
4703 and 4717; Precinct 4707, being a consolidation of Precincts 4707
and 4713; Precinct 4714, being a consolidation of Precincts 4714 and 4719;
and Precinct 4718, being a consolidation of Precincts 4718 and 4724,
as established for holding state and county elections; and
The whole number of persons voted for was 2 ; the whole number of
votes cast was 9 Oh7 including .......3.62- absentee ballots; that the
,
names of the persons voted for, the office for which they were voted,
and the number of votes received by each of said persons in each of
said precincts, together with the absentee votes, together with the whole
number of votes which they received in the entire City are as set forth
in the attached Exhibit "A".
RESOLVED, therefore that at the said general municipal election held
in the City of Saratoga April 8, 1980, the following persons were
elected to the following offices respectively;
Martha Clevenger
John Mallory
Each elected a member of the City Council for a full term of four
years.
RESOLVED FURTHER: That the City Clerk shall enter upon the record
of the City Council the results of said General Municipal Election
and shall deliver to each person elected a Certificate of Election duly
signed and authenticated by him, and he shall impose the constitutional
Oath and have them subscribe ~hereon, whereupon they shall be inducted
to the respective offices to which they have been elected.

(1) The only access to the area is Pierce Road, which is hazardous even at
the present rate of traffic. Moreover, the only solutions to improving access are to make
expensive improvements to Pie,ce Road or to construct an alternative access road,
both of which would involve undue cost and destruction of rural character.
(2) Because of steep slopes, potential landsliding, and other geotechnical haz·
ards, development at the maximum densities allowed under present zoning requires ex·
cessive grading, unacceptable erosion. destruction of natural topography and degradation
of natural drainage systems, aU contrary to the objectives of the General Plan.
(3) Maintenance of streets and storm drains of new hillside development poses
financial risks for the city.
e. To ensure that the goals of the 1974 Plan are met. a specific plan far the North·
Wl!st Hillsides area must be prepared which protects the rural character of the area
through substantially lower density and better relationship between development and
the land. Furthermore. interim controls on development must be imposed pending com·
r-Ietion of the Specific Plan.
S~" -.~...., SUBJECT AREA.
The ;jl... ')f the city affl!cted by this ordinance (the "subject area") is shown on
the map attach~d hèf.:tc as :'x!ìibit "A", and includes all lands in the "HC·RD" zoning
district north of Congress Splm¡~3 Road, all lands in the urban service area north of
Congress Springs Road, and all other lands that must gain access by way of Pierce Road,
SECTION 3, PREPARATION OF A SPECIFIC PLAN.
The City of Saratoga shall within one year from the effective date of this ordinance,
or as soon thereafter as feasible, complete a comprehensive review of all development
issues in the subject area and adopt a Specific Plan for the area pursuant to CalilarrHa
Government Code Sections 65450-65553, incorporating the standards set forth in St'r:
tion 4 below, and all pOlicies and regulations required to implement said Plan.
SECTION 4, STANDARDS,
The Plan shall incorporate the following standards, in addition to all others required
by law:
a. Density, The Plan shall be fully responsive to the policies and objectives of the
city as embodied in the adopted General Plan, the physical conditions in the area, and
the availability of public services and facilities needed by present and future inhabitants.
To accomplish this the .Plan shall establish detailed population and dwelling unit
holding capacities for the area as well as land use regulations consistent with such
holding capacities. The Plan shall also establish that at a maximum. the density of all
new residential development in the area shall not exceed that permitted under a "straight
line" slope·density formula where a minimum of two acres per dwelling unit is required
at 0% average ground slope and a minimum of ten acres per dwelling unjt is required
at 50% or greater average ground slope. Maximum densities shall be decreased on a
sliding scale jn relation to severity of geotechnical hazards.
b.' Access and cirçulation. Pierce Road shall not be improved in any manner that
will significantly alter the character of its corridor. Alternate access roads shall be con·
sidered only if fully compatible with the goals of this ordinance.
C. Preservation of Rural Character. Regulations shall be established to ensure,
to the fullest extent feasible, that all development: (I) Avoids geologic hazards; (2)
Controls erosion; (3) Preserves the natural drainage system, topography and natural
creekside vegetation.
d. Staging of Growth. Development shall be staged so that pUblic services and
facilities are not overtaxed and noise levels are minimized.
e. Street and Storm Drain Maintenance. Special assessment districts shall be
formed withil1 ¡¡ew subdivisions to contribute toward the maintenance of the streets
and to fully fund storm drains requjred by said developments.
SECTION 5. PUBLIC PARTICIPATION.
Preparation of the Plan shall involve full citizen input, as required by law, and
shall include as a minimum the foHowing:
a. Appointment of a Citizens Advisory Committee that is fully representative of
concerned citizens, particularly those residing il1 and adjacent to the subject area.
b. Presentation of all aspects of the Plan to the Committee for review and com·
ment prior to or cOl1current with consideration by the Planning Commission.

SECTION 6. CONSISTENT ZONING.
