A RESOLUTION OF THE CITY COilliCIL OF
THE CITY OF SARATOGA ESTABLISHING
CRITERIA FOR EVALUATING HARDSHIP
EXEMPTION APPLICATIONS UNDER SECTION 7,
INTERIM RESTRICTIONS OF MEASURE A.
1, vffiEREAS, on April 8, 1980, a majority of the voters of
the City of Saratoga, State of California, did vote in favor of
an Initiative Ordinance popularly referred to as Measure A, and
said Initiative Ordinance went into effect on April 25th, 1980,
the same having been adopted 10 days earlier upon declaration of
the vote by the City Council of the City of Saratoga;
2. WHEREAS, Section 7 of Measure A provides for consideration
of hardship exemptions to the required moratorium, if such exemptions
represent extreme hardship, are in agreement with the provisions
of said Measure A, and are approved by 4/5's vote of the City
Council after two (2) noticed public hearings;
3. WHEREAS, certain criteria are felt to be necessary in
evaluating applications for hardship exemptions under the provisions
of Section 7 of Measure A;
NOW THEREFORE, the City Council of the City of Saratoga hereby
resolves as follows:
1. The following specific criteria, formulated as questions
to the applicant, are listed in order to provide clear direction
as to what will be evaluated upon review of hardship exemptions
to the Measure A moratorium:
A. Is the project being developed as a subdivision, or
by a single lot owner for said owner's single family
residence?;
B. Is the development in agreement with the provisions
specified in Measure A on density, access and circulation,
preservation of rural character, staging of growth, and
street and storm drain maintenance in accordance with
the provisions of Measure A?;
C. How close is the project to completion?;
D. If the project were delayed until completion of the
specific plan required by Measure A, what would be the
hardships or economic losses to the applicant?;
E. ~fuat other factors about the specific applicable lot,
or structure demonstrate extreme hardship?;
F, Will the exception to the Measure A moratorium con-
stitute a grant of special privileges inconsistent with
the limitations on other undeveloped properties in the
Measure A subject area?;
G. Could the exception in arty way compromise the develop-
ment of a specific plan for the Measure A area, and/or
compromise the Measure A objectives?
2. An exception to the Measure A moratorium, according to
the provisions of Section 7 of Measure A, requires 4/5's vote by the City
Council, including specific findings by the City Council that
strict application of the Measure A moratorium constitutes an
extreme hardship and that the proposed project is in agreement
with the provisions of the Measure A standards.
3. Applications for exceptions to the moratorium under
Section 7 of Measure A shall be by filing written requests therefor
with the City Clerk. Said requests shall state all grounds for
the application and all facts relied upon, and shall specify why
the application meets the evaluation criteria defined herein and
in Measure A.
THE ABOVE AND FOREGOING RESOLUTION was adopted at a regular
meeting of the City Council held on the 4th day of June, 1980
by the following vote:
