RESOLUTION NO. 975
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SARATOGA AMENDING THE 1974 GENERAL PLAN
LAND USE ELEMENT AND GENERAL PLAN TEXT FOR
AN AREA KNOWN AS SUNLAND PARK
WHEREAS, the Planning Commission conducted a duly noticed
public hearing on August 27, 1980 regarding the amendment to the
1974 General Plan dated August 9, 1974, and the Land Use Element
of said document; and
WHEREAS, the Planning Commission adopted Resolution GF-327,
which recommends approval of the General Plan Amendment with
Exhibits "A" and "B" to the City Council; and
WHEREAS, the City Council considered a Negative Declaration
prepared in accord with provisions of the California Environmental
Quality Act; and
WHEREAS, the City Council considered a General Plan Amend-
ment after conducting a public hearing on September 17, 1980;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Saratoga hereby approves the General Plan Amendment in the
form of Exhibit "A" and Exhibit "B" attached hereto.
The above and foregoing resolution was regularly introduced
and thereafter passed and adopted by the Saratoga City Council
on the 17th day of Septanber , 19 8 0 by the
following vote:

GENERAL PLAN AMENDMENT
To provide for the annexation of the area known as Sunland Park to the
City of Saratoga, the 1974 Saratoga General Plan shall be amended as
follows:
I. The official General Plan Map (August 9, 1974) shall include an area
of approximately 52.7 acres, bounded on the west by Quito Road,
on the south by McCoy Avenue, on the east by Villanova, and on
the north by the rear line of properties on the north side of
Baylor Avenue. The area shall bear the residential designation
of medium density.
II. The planning areas map, page 21 of the Saratoga General Plan 1974
document, shall show Sun land Park as Planning Area K.
III. The Action Program of the Saratoga General Plan 1974 document,
shall include this text, following page 54:
AREA K - SUNLAND PARK
Sunland Park is a neighborhood of 200 single-family residences,
built as a single tract in the mid-1950s. The lots vary in size
from approximately 8,000 square feet to well over 10,000 square
feet in a few instances. The average lot size is about 8,100
square feet. The majority of homes are thus situated on legal
non-conforming lots. Homes and landscaping are generally well
maintained. Approximately ninety percent of the homes are
owner occupied.
The neighborhood is served by Quito Road, the arterial which
borders it to the west. McCoy Avenue, on the south, is a
collector street. The other streets in the neighborhood are
local access streets. There are street deficiencies which
should be corrected to conform to City Standards.
Sunland Park was an unincorporated area within the sphere of
influence of the City of San Jose. Under the terms of the
Municipal Organization Act of 1977, San Jose sought to annex the
area. The Sunland Park residents contended their identification
with Saratoga was greater and petitioned the City to initiate
steps to annex the area instead, a request approved by the Local
Agency Formation Commission. The agencies and districts which
provide services to Sunland Park also serve areas of Saratoga
west of Quito Road. Sunland Park homes bear Saratoga mailing
addresses. Sunland Park residents frequent shopping areas and
parks in Saratoga west of Quito Road.
Proposals
1. The City shall encourage the homeowners' assooiation to
inform the residents of the provisions of the Saratoga
City Code, and urge compliance with the code as feasible,

recognizing that many of these are legal non-conforming
lots.*
2. The property owners shall participate, through formation of
an assessment district, in improvements specified by the
City to Quito Road, Purdue Drive, and McCoy Avenue.
Improvements to Quito may be deferred until further study
is completed.**
