RESOLUTION OF THB CITY COUNCIL
OF TBB CIIJ."Y OF SARATOGA INITIATING
PROCBBDIlIGS POa mE A.I!IIĊXATION OP THE
AREA COMMOIILY K901111 AS SUNLAND PARI(
WHEREAS, the City of Saratoga was presented with a
petition for annexation submitted by residents of the area bordered
by Baylor Avenue on the north, McCoy Avenue on the south, Quito
Road on the west and Villanova Drive on the East, as described and
shown on Exhibit "A" attached hereto and made a part hereof, such
area commonly known as Sunland Park; and
WHEREAS, following a noticed public hearing on June 18,
1980, the City Council made all of the findings required by the
Local Agency Formation Commission (I1LAFCO") and voted to pursue
annexation of Sunland Park to the City of Saratoga; and
WHEREAS, a comprehensive site specific plan for services
was submitted to LAFCO and on August 6, 1980, LAFCO approved the
proposed boundary transfer and determined that Sunland park was
henceforth to be considered as within the sphere of influence of
the City of Saratoga; and
WHEREAS, following a noticed public hearing, on September
17, 1980, the City Council voted to amend the map and text of the
General Plan of the City of Saratoga to include Sun land Park as a
new "Area Kil, and further voted to prezone the Sunland Park area
as an R-I-lO,OOO district. In connection therewith, the City
Council also approved a Negative Declaration for the proposed
annexation of Sunland Park and the related amendments to the
General Plan and the Zoning Ordinance; and
WHEREAS, on September 17, 1980, the City Council adopted
Resolution No. 974, authorizing and directing the City Manager to
execute for and on behalf of the City of Saratoga an Application
for Annexation of Sunland Park, and to submit such Application to

LAFCO for approval; and
WHEREAS, on November 5, 1980, LAFCO duly approved the
proposed annexation of Sunland Park to the City of Saratoga; and
WHEREAS, it is necessary for the City Council to now
adopt a resolution initiating the final annexation proceedings;
and
WHEREAS, a public hearing was conducted by the City
Council on December 3, 1980, notice thereof having been given to
all of the residents of Sun land Park and otherwise as required by
law, at which time any owner of land within Sunland Park or
registered voter residing within said area was given an opportunity
to protest the proposed annexation; and
WHEREAS, the residents of Sun land Park desire to be
annexed to the City of Saratoga, in order to avoid a reduction of
services which would result from annexation to the City of San
Jose, and the City Council has found and determined that the
proposed annexation to the City of Saratoga should be made for
such reason¡
NOW, THEREFORE, BE IT RESOLVED that pursuant to Section
35220 of the Government Code, the City Council does hereby initiate
the final proceedings for annexation to the City of Saratoga of
the inhabited area bordered by Baylor Avenue on the north, McCoy
Avenue on the south, Quito Road on the west and Villanova Drive on
the east, as described and shown on Exhibit "An attached hereto,
such area commonly known as Sun land Park.
BE IT FURTHER RESOLVED that the proposed annexation of
Sunland Park shall be conditioned upon all of the following
requirements having been satisfied:
1. The residents of Sunland Park shall have reimbursed
the City of Saratoga for all costs it has or will incur in connec-
tion with the annexation, including, but not limited to, publica-
tion and mailing of notices, inspection of street improvements,
state filing fees, and recording fees.
2.
2. An arràngement satisfactory to the City relative
to the improvement of McCoy Aven~e and Purdue Drive at no expense
to the City must be agreed upon prior to annexation.
3. An arr~ngemept satisfactory to the City relative
to the possible future improvement of Quito Road must be agreed
upon prior to annexation.
BE IT FURTHER RESOLVED, that the public hearing on the
annexation shall be continued to the regular meeting of the City
Council on January 7, 1981, and notice thereof be given in the
manner prescribed by Section 35222 of the Government Code. Any
owner of land within Sunland Park or any registered voter residing
within said area may file a written protest against the proposed
annexation with the Saratoga City Clerk at any time prior to the
conclusion of the public hearing on January 7, 1981.

Council of the City of Saratoga held on December 3, 1980, by the
following vote:

Beginning on the south easterly corner of the city limit of
San Jose as annexed by Bucknall Annexation No.1 (Annex. #269),
said point lying on the northerly limit of aforementioned Tract
977, bearing N 880 26' E 719.11' from the westerly Right of Way
of Quito Road; thence leaving the San Jose City Limits along
the northerly limit of Tract 977, N 880 31' E 229.01' to the
south westerly limit of the City of San Jose as annexed by
Bucknall Annexation No. 11, (Annex. 468); thence along the
Southerly limit of the City of San Jose N 88° 40' E 7.09' to
the South Westerly limit of San Jose, Bucknall Annex. No.2,
(Annex. #347); thence along the southerly limit of the City of
San Jose N 880 31' E 451.81' to the centerline of Villanova Road
