RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA ORDERING ANNEXATION OF THE AREA
COHMONLY KNOWN AB SUNLAND PARK
WHEREAS, the City of Saratoga was presented with a
petition submitted by residents of the area bordered by Baylor
Avenue on the north, McCoy Avenue on the south, Quito Road on
the west and Villanova Drive on the east, as described and shown
on Exhibit "A" attached hereto and made a part thereof, such
area commonly known as Sunland park¡ and
WHEREAS, in connection with the proposed annexation,
appropriate amendments have been adopted to the map and text of
the General Plan of the City of Saratoga to include Sunland Park
as a new "Area K", and such area has been pre-zoned as an R-l-IO,OOO
district; and
WHEREAS, proceedings have been duly conducted before
the Local Agency Forrr.ation Commission ("LAFCO"), and on November 5,
1980, LAFCO approved the proposed annexation of Sunland Park to
the City of Saratoga¡ and
WHEREAS, on December 3, 1980, the City Council adopted
a resolution initiating the final proceedings for the annexation
of Sunland Park, and specifying the conditions to be satisfied
before the annexation could be completed; and
WHEREAS, public hearings were conducted by the City
Council on December 3, 1980 and January 7, 1981, notice thereof
having been given to all of the residents of Sunland Park and
otherwise as required by law, at which time any owner of land
within Sunland Park or registered voter residing within said area
was given an opportunity to protest the proposed annexation.
The City Council has heard and considered all oral and
written protests, objections and other evidence filed or presented
at the public hearings, and hereby makes the following findings:
1. Written protests to the annexation have not been
filed by twenty-five percent (25%) or more of the registered voters
within Sun land Park or twenty-five percent (25%) or more of the
owners of land who own twenty-five percent (25%) or more of the
total assessed value of land within Sunland Park;
2. The residents of Sunland Park have reimbursed the City
of Saratoga for all costs it has incurred in connection with the
annexation;
3. The residents of Sunland Park have deposited with the
City of Saratoga a cash amount considered to be sufficient for pay-
ment of all costs of the required improvements to McCoy Avenue and
Purdue Drive;
4. At least seventy percent (70%) of the residents of
Sunland Park have duly executed an agreement consenting to the
establishment of Sun land Park as an assessment district for the
purpose of future improvements to Quito Road;
5. All conditions imposed by the City of Saratoga for
annexation of Sun land Park have now been fully satisfied;
6. All conditions imposed by LAFCO must be met prior to
June 3, 1981, and certified by the City to the Executive Officer
of LAFCO.
NOliJ, THEREFORE, BE IT RESOLVED, that pursuant to Section
35228(c) of the Government Code, the City Council does hereby order
that the area described in Exhibit "Au attached hereto, commonly
known as Sunland Park, be annexed to and made a part of the City
of Saratoga.
The City Clerk is hereby authorized and directed to
furnish a certified copy of this Resolution to LAFCO, together
with a request for LAFCO to forthwith execute a certificate of
completion of proceedings, and to file the same with the City Clerk,
the County Surveyor and the County Recorder, as provided by law,
such certificate to be effective on the date of recordation in the
office of the Recorder for Santa Clara County, California.

Council of the City of Saratoga held on January 7, 1981, by the
following vote:
AYES, and in favor thereof, Councilmembers:
Clevenger, Jensen, Mallory, Watson, and Mayor Callon
