RESOLUTION NO. 1063
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA A/4ENDING THE 1974 GENERAL PLAN LAND
USE ELEMENT FOR A 10.58 ACRE PARCEL OF LAND
COMMONLY KNOWN AS THE CONGRESS SPRINGS SCHOOL
SITE IAPN 391-4-11)
WHEREAS, the Saratoga Union School District is the owner
of a certain 10.58 acre parcel of property located at the north-
western corner of the intersection of Via Escuela Drive and Glen
Brae Drive commonly known as Congress Springs School and as shown
on Exhibit "A" attached hereto and incorporated herein by reference;
and
WHEREAS, the City of Saratoga received an application
from the Saratoga Union School District to amend the 1974 General
Plan Land Use Element designation of this parcel from "Community
Facilities School Site" to "Medium Density Residential"; and
WHEREAS, the City of Saratoga Planning Commission at a
regular meeting in accord with Government Code Section 65351,
held a public hearing on January 13, 1982, and reviewed the
proposed amendment to the Land Use Element; and
WHEREAS, after the closing of said public hearing,
the Planning Commission adopted a resolution recommending that
the City Council amend the 1974 General Plan Land Use Element
designation for the said 10.58 acre parcel from "Community
Facilities School Site" to "Medium Density Residential"; and
~EREAS, the City Council of the City of Saratoga,at
a regular meeting on March 3, 1982, held a public hearing in
accordance with Government Code Section 65355, and reviewed
the proposed amendment to the said Land Use Element;
Having heard the evidence presented, both written and
oral, the City Council of the City of Saratoga hereby MAKES THE

FOLLOWING FINDINGS in connection with the proposed amendment to
the Land Use Element of the 1974 General Plan:
1. The proposed General Plan Amendment is consistent
with the policies and objectives of the 1974 General Plan.
2. The proposed General Plan Amendment is necessary and
is in the public interest in that the subject property has been
declared surplus school lands by the Saratoga Union School District
and a land use redesignation of the property is necessary for any
other use.
3. The General Plan Citizens Advisory Committee has
recommended that the subject property be given a residential
designation and the proposed General Plan Amendment is consistent
with that designation.
4. The proposed General Plan Amendment will have no
adverse impact on the surrounding area in that it will maintain
the residential character of the neighborhood.
5. The proposed General Plan Amendment will not adversely
affect the public safety, health and welfare or be materially
injurious to adjacent properties or improvements.
NOW, THEREFORE, based upon the findings set forth herein-
above, the City Council of the City of Saratoga resolves as follows:
That the Land Use Element of the 1974 General Plan be,
and the same is hereby, amended with respect to a 10.58 acre parcel,
commonly known as Congress Springs School and shown on Exhibit "A"
attached hereto to show a land use designation of "Medium Density
Residential" in place of the present designation of "Community
Facilities School Site".
The above and foregoing resolution was passed and adopted
at a regular meeting of the City Council of the City of Saratoga
held on the !7th day of M~r~h. , 1982, by the following vote:
