OF THE CITY OF SARATOGA

VPHEREAS, the California State Legislature has enacted
AB 1253 and the Governor has signed it into law, and
WHEREAS, AB 1253 reduces the amount of employer contributions
for school districts, county superintendents of schools, community
college districts and State employees totaling $187 million, and

for 1981-82, and
WHEREAS, this rescue results from the employer contributions
of all member agencies, not merely the State and school districts, and
WHEREAS, implementation of AB 1253 should be opposed because
it is fiscally imprudent and establishes a dangerous precedent that
could lead to further "raiding" of the retirement system to the
financing of the, zState budget; and
WHEREAS, PERS Fund is held in trust by the State and must be
used solely and equitably for the benefit of its members, retirees
and survivors,
THEREFORE, BE IT RESOLVED by the City Council of Saratoga that:

Board of Administration should refuse to make transfers required by
AB 1253 unless ordered to do so by an Appellate Court, and 2) if
