HomeMy WebLinkAboutCity Council Resolution 1091 RESOLUTION NO. 1091 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA MODIFYING A DECISION OF THE PLANNING COMMISSION, MAKING REQUISITE FINDINGS, AND CHANG- ING CONDITIONS FOR TENTATIVE SITE APPROVAL SDR-1Sll WHEREAS, applicant Clarence Neale did appeal that certain condition of Tentative Site Approval (II-C) requiring emergency access; and WHEREAS, on May 19, 1982 the City Council held a de novo public hearing, and after the closing of said public hearing reviewed and considered the applicant's request, staff reports, minutes of Planning Commission meetings, comments by Saratoga Fire District, and other agencies, both written and oral, pre- sented to the Council during said public hearing. NOW, THEREFORE, the City Council of the City of Saratoga HEREBY RESOLVES as follows: 1. The appellant's appeal from the Planning Commission is granted and the decision of the Planning Commission requiring the construction of an emergency access is overruled, with the provision that a fire hydrant will be installed adjacent to or within the subject property. 2. The Council makes all of the findings as set out in Exhibit "A" attached hereto and incorporated herein by reference. 3. Having made the appropriate findings, SDR-1Sll is hereby approved as modified. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 2nd day of' June, 1982 , by the following vote: AYES: Councilmembers Clevenger, Mallory, Watson, and Mayor Callon NOES: Councilmember Jensen ABSEN?: None ATTEST: ,.,~,l~ ~^ [4Y ~2~ _ EXHIBIT "A" REPORT OF FINDINGS SDR-1511 1. The road over which the emergency access road was to be constructed is a well drained compacted gravel, which should provide access in an unpaved condition. 2. Installation of a fire hydrant adjacent to or within the site will provide a more adequate fire flow for the protection of this site and adjacent developments. 3. In the opinion of the City Council the only feasible method for developing the property for the use for which it is zoned is on a cul-de-sac over 400 feet in length. 4. Said project complies with all objectives of the 1974 General Plan, and all requirements of the Zoning and Subdivision Ordinances of the City of Saratoga. S. The housing needs of the region have been considered and have been balance against the public service needs of its residents and available fiscal and environmental resources.
