RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA AMENDING THE 1974 GENERAL PLAN LAND USE
ELEMENT FOR THE FOLLOWING PARCELS:
1. A 11.57 ACRE PARCEL OF LAND COMMONLY KNOWN AS THE BROOKVIEW
SCHOOL (APN 386-10-60)
2. A 4.89 ACRE PORTION OF A PARCEL OF LAND COMMONLY KNOWN AS
THE EL QUITO PARK SCHOOL (PORTION OF APN 386-14-4)
3. A 5.72 ACRE PARCEL OF LAND COMMONLY KNOWN AS THE SARATOGA
HORTICULTURAL FOUNDATION (APN 503-20-91)
4. A 3.69 ACRE PARCEL OF LAND AT THE NORTHEAST CORNER OF
SARATOGA-SUNNYVALE ROAD AND MILJEVICH DRIVE (APN 391-25-55)
-WP~E~AS, the Moreland School District is the owner of
parcels 1 (located at 12301 Radoyka Drive) and 2 (located at 18729
Bucknall Road) listed above, the Saratoga Horticultural Foundation
is the owner of parcel 3 (located at 20605 Verde Vista Lane) listed
above, and Nedjo Spaich is the owner of parcel 4 listed above, and
shown as Exhibits "A", "B", "C" and "D" attached hereto and incorp-
orated herein by reference; and
WHEREAS, the City of Saratoga received application from the
Moreland School District, the Saratoga Horticultural Foundation,
and Nedjo Spaich to amend the 1974 General Plan Land Use Element
designation of the four parcels listed above as follows:
Parcel 1. From "Community Facilities - School Site" to
"Medium Density Residential"
Parcel 2. From "Community Facilities - School Site" to
"Medium Density Residential"
Parcel 3. From "Private Open Space" to "Medium Density
Residential"
Parcel 4. From "Proposed Park" to "Medium Density Residential";
and
WHEREAS, The City of Saratoga Planning Commission at
regular meetings in accord with Government Code Section 65351,
held public hearings on May 26, 1982 for parcels 1 and 2, February
24, 1982 for parcel 3, and June 23, 1982 for parcel 4, and reviewed
the prooposed amendments to the Land Use Element; and
WHEREAS, after the closing of said public hearings, the
Planning Commission adopted resolutions recommending that the City
Council amend the 1974 General Plan Land Use Element designations
for the four parcels as follows:
Parcel 1. (11.57 acreS) from "Communty Facilities -
School Site" to "Medium Density Residential"
Parcel 2. (4.89 acres) from "Community Facilities -
School Site" to "Medium Density Residential"
Parcel 3.. (5.72 acreS)from "Private Open Space" to
"Medium Density Residential"
Parcel 4.! (3~69 acres)from "Proposed Park" to "Medium
Density Residential"; and
WHEREAS, the City Council of the City of Saratoga, at
a regular meeting on August 4, 1982, held a public hearing in
accordance with Government Code Section 65355, and reviewed the
proposed amendments to the said Land Use Element;
Having heard the evidence presented, both written and oral,
the City Council of the City of Saratoga hereby MAKES THE FOLLOWING
FINDINGS in connection with the proposed amendments to the Land Use
Element of the 1974 General Plan:
1. The proposed General Plan Amendments are consistent
with the policies and objectives of the 1974 General Plan.
2. The proposed General Plan Amendments will maintain the
residential character of the neighborhoods affected and will have
no adverse impact on the surrounding areas.
3. In the case of parcels 1 and 2 the proposed General Plan
Amendments are consistent with the policies recommended by the GPCAC
to place a residential designation, consistent with the surrounding
neighborhood, on vacant school property.
4. The proposed General Plan Amendments will not adversely
affect the public safety, health and welfare or be materially in-
jurious to adjacent properties or improvements.
5. In the case of parcels 3 and 4, the proposed General
Plan Amendments are consistent with the policies recommended by
the GPCAC to place a residential designation, consistent with the
surrounding neighborhood, on vacant property.
6. In the case of parcel 4, the City's financial position
does not allow the purchase of the property and makes the current
proposed park designation inappropriate to maintain.
NOW, THEREFORE, based upon the findings set forth herein-
above, the City Council of the City of Saratoga resolves as follows:
That the Land Use Element of the 1974 General Plan be,
and the same is hereby amended with respect to the following parcels:
1. The 11.57 acre parcel commonly known as the Brookview
School and shown on Exhibit "A" attached hereto to show
a land use designation of "Medium Density Residential"
in place of the present designation of "Community Faci-
lities - School Site".
2. The 4.89 acre portion of a parcel commonly known as
the E1 Quito Park School and shown on Exhibit "B" of
"Medium Density Residential" in place of the present
designation of "Community Facilities - School Site".
3. The 5.72 acre parcel commonly known as the Saratoga
Horticultural Foundation and shown on Exhibit "C"
attached hereto to show a land use designation of
"Medium Density Residential" in place of the present
designation of "Private Open Space".
4. The 3.69 acre parcel at the northeast corner of
Saratoga-Sunnyvale Road and shown on Exhibit "D"
attached,hereto to show a land use designation of
"Medium Density Residential" in place of the present
designation of "Proposed Park".
The above and foregoing resolution was passed and adopted
at a regular meeting of the City Council of the City of Saratoga
held on the 4th day of August, 1982, by the following vote:
AYES: Councilmembers Clevenger, Fanelli, Mallory, Moyles and Mayor Callon
