A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SARATOGA DECLARING THE EXISTENCE OF A
GREAT PUBLIC CALAMITY AND AUTHORIZING THE
IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO
SAFEGUARD LIFE, HEALTH AND PROPERTY.
WHEREAS, during the winter of 1982-1983 numerous and
severe storms have dumped record amounts of rainfall within the
City of Saratoga; and
WHEREAS, said rainfall has substantially raised the
ground water level within the City thereby causing flooding,
reactivating certain previously existing landslides and causing
new landslides to occur; and
WHEREAS, some of these reactivated or new landslides
have caused damage to City property or public improvements
thereby directly creating a public interest in repairing and
restoring said City property or public improvements; and
WHEREAS, in order to safeguard the life, health
and property within the City, these repairs and restorations
of said City property or public improvements must be done
immediately.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The flooding and landslides resulting from the
numerous storms and rainfall occurring during the winter of
1982-1983 have caused a great public calamity to presently
exist within the City of Saratoga; and
2. Pursuant to Public Contract Code ~20168 of the
State of California, the City Council of the City of Saratoga
hereby declares that the public interest and necessity demand
that public money be immediately expended to safeguard life,
health and property within the City of Saratoga. Accordingly,
the council may inmediately and frnm time to time hereafter authorize the
expenditure of public honeys without complying with Chapter 1 Division 2 Part
3 of the Public Contract Code.
3. This resolution shall remain in full force and effect during
the continued existence of the federal disaster declaration previously made
or until August 1, 1983, whichever occurs later.
The above and forecjDing resolution was passed and adopted at a special meeting
of the Saratoga City Council held on the 24th day of March, 1983, by the
following vote:
AYES: Councilnenkers Clevenger, Fanelli, Mallory, Moyles and Mayor Callon
