HomeMy WebLinkAboutCity Council Resolution 2137~24/17 WMAM:JEB:kn 03/23/84 12c RESOLUTION NO. 2137 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO AN EXISTING ASSESSMENT DISTRICT KNOWN AS "CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA-i" PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 RESOLVED, by the City Council of the City of Saratoga, California, as follows: 1. The public interest, convenience and necessity require, and it is the desire of this Council to undertake proceedings for the annexation of territory to an existing assessment district, known as "City of Saratoga Landscaping and Lighting District LLA-I", pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California, for the construction or installation therein of improvements, including the maintenance or servicing, or both, thereof. 2. The improvements to be constructed or installed, within the territory proposed for annexation including the maintenance or servicing, or both, thereof, are more particularly described in Exhibit "A" hereto attached and by reference incorporated here in. 3. The costs and expenses of said improvements, including the maintenance or servicing, or both, thereof, are to be made chargeable upon the area to be annexed to said existing assessment district. The territory which is proposed to be annexed to said existing assessment district is composed of several parcels, the exterior boundaries of which are more particularly described in Exhibit roB' hereto attached and by reverence made a part hereof. The annexation herein proposed shall be known as, and is given the distinctive designation of 'City of Saratoga Landscaping and Lighting District LLA-1 Annexation 1984-1'. A map showing the territory proposed for annexation is on file in the office of the City Clerk to which reference is hereby made for further particulars. 4. The Engineers of said City be, and is hereby directed to prepare and file with said Clerk a report, in writing, referring to the proposed annexation by its distinctive designation, specifying the fiscal year to which the report applies, and, with respect to that year, presenting the following: a) plans and specifications of the existing improvements and for proposed improvements, if any, to be made within the area proposed to be annexed to the existing assessment district and to be assessed herein~ b) an estimate of the costs of said improvements, if any, to be made and of the costs of maintenance or servicing, or both, thereof and of any existing improvements, together with the incidental expenses in connection therewith ~ c) a diagram showing the exterior boundaries of the area to be annexed to the existing assessment district, which is also the area proposed to be assessed here in and the lines and dimensions of each lot or parcel of land within said area as such lot or parcel of land is -2- shown on the County Assessor~s maps for the fiscal year to which the report applies, each of which lots or parcels of lands shall be identified by a distinctive number or letter on said diagram~ and d) a proposed assessment of the total amount of the estimated costs and expenses of the proposed improvements, including the maintenance or servicing, or both, thereof, upon the several lots or parcels of land in said area proposed to be annexed and assessed here in in proportion to the estimated benefits to be received by such lots or parcels of lands,' respectively, from said improvements, including the maintenance or servicing, or both, thereof, and of the expenses incidental thereto. 5. The Office of the Director of Community Development Regulation of said City be, and is hereby, designated as the office to answer inquiries regarding any protest proceedings to be had herein, and my be contacted during regular office hours at the City Hall, 13777 Fruitvale Avenue, California 95070, or by calling (408) 867-3438, Extension 30. -3- I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the 18th day of April , 1984 ., by the following vote of the members thereof: AYES, and in favor thereof, Council Members: Councilme Clevenger and Mallory and Mayor Moyles NOES, Council Members~ None ABSENT, Council Members= Councilmembers Callon and Fanelli City Cierk=of {he C~'~y of Saratoga APPROVED: CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA-1 DESCRIPTION OF WORK a) The construction or installation, including the maintenance or servicing, or both, thereof, within Zone 10 and 11 as herein- after described, of landscaping, including trees, shrubs, grass, or other ornamental vegetation, statuary, fountains and other ornamental structures and facilities, including the cost of repair, removal or replacement of all or any part thereof, pro- viding for the life, growth, health and beauty of landscaping, including cultivation, irrigation, trimming, spraying, fertilizing or treating for disease or injury, the removal of trimmings, rubbish, debris and other solid waste, water for the irrigation of any landscaping, the operation of any fountains or the mainten- ance of any other improvements. EXHI BIT "'A" EXHIBIT "B" THAT CERTAIN PROPERTY SITUATED IN THE CITY OF SARATOGA, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA MORE PARTICULARLY DESCRIBED AS FOLLOWS: 1. All Lots designated as Lot Number 69 through 134 shown on the tract 2835 recorded in Book 162 of maps at pages 14 and 15 in the Santa Clara County Recorders Office. 2. All Lots designated as Lot Number 1 through 68 shown on the tract 2694 recorded in book 147 of Maps at Pages 42 and 43 in the Santa Clara County Recorders Office 3. All Lots designated as Lot Numbers 135 through 152 and Lot numbers 178 through 187 shown on tract 2844 recorded in book 175 of maps at pages 16 and 17 in the Santa Clara County Recorders Office. 4. All Lots designated as Lot Numbers 1 through 10 and 19 through 31 shown on the tract 3036 recorded in book 158 of maps at page 15 in the Santa Clara County Recorders Office. 5. All Lots designated as Lot Number 1 through 64 shown on the tract 4344 recorded in book 230 of maps at pages 30, 31, 32 and 33 in the Santa Clara County Recorders Office. 6. The Land designated as Parcel A and B on the record of Survey Map recorded in Book 129 of map on page 29 with Santa Clara County Recorders Office.
