CITY OF SARATOGA UPHOLDING A DBCIMION OF THE PLANNING COMMIMSION WHEREAS, the Moreland School District has applied to the City of Saratoga for tentative subdivision approval for 36 lots on the premises commonly known as the Brookview School site, such application being identified as SD-1554; and WHEREAS, on April 11, 1984, and April 25, 1984, the Planning Commission of the City of Saratoga conducted a public hearing on said application and following the conclusion thereof the Planning Commission approved the application; and WHEREAS, A1 and Lorraine Burden have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on June 6, 1984, the City Council conducted a de novo public hearing on the appeal at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga at its regular meeting on June 6, 1984, by a vote of four to one with Councilmember Clevenger opposed did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The City Council found and determined that the final environmental impact report was adequate; that certain adverse environmental impacts would be caused by the project, in particular the loss of open space and recreational facilities, but such adverse impacts could not be avoided or mitigated; and that the design of the subdivision with respect to traffic circulation was preferable to other alternatives proposed by the appellants. 3. As a condition for approval, the Council ordered that Obrad Street be closed until construction work within the subdivision has been completed and thereafter said road shall be open as a regular means of access. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 20th day of June, 1984, by the following vote: -1- AYES: Councilmembers Clevenger, Hlava, Moyles and Mayor Fanelli NOES: None ?J~h~or ATTEST: Deputy City Clerk
