RE~OLUTION OF THE CITY COUNCIL OF THE CITY O1~
SARATOGA REVERSING A DECIgION OF THE PLANNING
COMMISSION
WHEREAS, LAZLO and ANNA SIPOS, the applicants have applied to the
City of Saratoga for design review approval to construct a single family residence on
A1]endale Avenue, such application being identified as A-1001, and
WHEREAS, on August 22, 1984, the Planning Commission of the City of
Saratoga conducted a public hearing on said application, and following the conclusion
thereof, the Planning Commission denied the application; and
WHEREAS, the applicants have appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on October 3, 1984, the City Council conducted a de novo
public hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga at its
meeting on October 3, 1984, by a vote of three to two with Councilmembers Moyles
and Clevenger dissenting, did resolve as follows:
l. The appeal from the Planning Commission was upheld and the
decision of the Planning Commission was reversed.
2. The City Council was able to make all of the findings required for
design review approval, based upon the following considerations:
(a) Existing residences in the immediate area are similar to or
larger in size than the proposed residence. Consequently, the
proposed residence is not incompatible with the neighborhood.
(b) The site is located within an R-I-20,000 District which serves as
a buffer zone between an adjacent R-I-10,000 District and an
adjacent R-1-40,00~) District. When viewed as a transitional
development between two Districts, the proposed residence will
be compatible with each adjacent District.
(c) None of the owners of neighboring properties has claimed a
privacy impact from the proposed residence or raised any other
objections to the project.

(d) Although the lower floor of the proposed residence is not a
basement, as defined in the design review ordinance, the fact
that a substantial portion of the structure will be constructed
below grade serves to reduce the height of the structure and
eliminate any percegtion of excessive bulk.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 17th day of October,
1984, by the following vote:
