RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA REVEP, SING A DECISION OF THE PLANNING
COMMISSION
WHEREAS, the Owen Companies, the applicant, has applied to the City of
Saratoga for a use permit, tentative building site approval and design review approval
to construct an office complex at the southeast corner of Cox and Saratoga Avenues,
such applications being identified as UP-535, SDR-1539 and A-989; and
WHEREAS, a draft Environmental Impact Report on the project was the
subject of public hearings conducted by the Planning Commission on June 27, 1984,
July ]], 1984, and July 25, ]984, and on August 8, 1984, the Planning Commission
certified the final Environmental Impact Report as adequate; and
WHEREAS, on August 22, 1984, September 18, ]984, and September 26,
1984, the Planning Commission conducted public hearings on said applications, and
following the conclusion thereof, the Planning Commission denied the applications; and
WHEREAS, the applicant has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on October 17, 1984, the City Council conducted a de novo
public hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
applications, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
continued regular meeting on October 23, 1984, by a vote of 3-2 with Councilmembers
Clevenger and Moytes dissenting, did resolve as follows:
1. The appeal from the Planning Commission was upheld and the
decision of the Planning Commission was reversed, subject to the
conditions set forth below.
2. The City Council granted the use permit, tentative building site
approval and design review approval, making the findings with
respect to such approvals as contained in the revised staff report
dated September 20, 1984, and subject to the conditions set forth in
said staff report together with the following additional conditions:
(a) The aggregate size of all buildings on the site shall not exceed
90,000 square feet.
(b) All buildings on the site shall be single story. No two story
structures will be allowed.

(e) Not less than 423 on site parking spaces will be provided.
(d) McFarland Drive may be utilized for ingress only to the project.
No egress from the project onto McFarland Drive will be
allowed.
(e) All buildings shall be located generally within the footprint of
the proposed structures as shown on the site plan submitted to
the Planning Commission.
3. Resolution No. 897, adopted by the City Council on May 2, 1979, was
modified to permit access for this project onto Saratoga Avenue, as
shown on the site plan submitted to the Planning Commission.
Except as modified for this project only, said Resolution No. 897
remains in full force and effect.
4. The City Council duly considered the contents of the Final
Environmental Impact Report prior to rendering its approval of the
project.
5. The applications were referred back to the Planning Commission for
further consideration and clarification of the conditions set forth in
the revised staff report, consistent with the decision rendered by the
City Council on the appeal.
The above and foregoing resolution was passed and a~j~ted at a regular
meeti of the City Council of the City of Saratoga held on the day
of ngNc~e~er .. ,1984, by the following vote:
A YES: Councilmembers Callon and FDyles and Mayor Pro Tern Hlava
NOES: None
ABSENT: Councilmember Clevenger and Mayor Fanelli
