1H~OLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPHOLDING A DECISION OF THE PLANNING
COMMISSION
WHEREAS, J. P. and GEERTIE DeVOS, the applicants, have applied to the
City of Saratoga for variance approval to allow a 10-foot privacy wall within the side
yard setback, upon the property located at 14681 Farwell Avenue, such application
being identified as V-662, and
WHEREAS, on October 10, 1984, and October 24, 1984, the Planning
Commission of the City of Saratoga conducted a public hearin~ on said application,
and following the conclusion thereof, the Planning Commission denied the application;
and
WHEREAS, on the applicants have appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on December 5, 1984, the City Council conducted a de novo
public hearinE on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City council reviewed and considered the staff reports,
minutes of proceedings conducted by the ;Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on December 5, 1984, by a vote of'3-2 with councilmembers Callon and
Hvlava dissenting, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.
2. The City Council Was unable to make the findings required for a
variance for the reasons stated in the staff report to the Planning
Commission dated October 3, 1984. The Council also noted that the
· existing 10 foot wall had been constructed by the applicants without
prior approval from the City.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 19th day of December,
1984, by the following vote:
