RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPHOLDIMG AND MODIFYING A DECISION OF
THE PLANNING COMMISSION
WHEREAS, the FREMONT UNION HIGH SCHOOL DISTRICT, the
applicant, has applied to the City of Saratoga for tentative map aproval for a 55 lot
subdivision located adjacent to Prospect Road, such application being identified as SD-
1567, and
WHEREAS, on January 23, 1985, February 13, 1985, February 27, 1985, and
March 13, 1985, the Planning Commission of the City of Saratoga conducted a public
hearing on said application, and following the conclusion thereof, the Planning
Commission approved the application; and
WHEREAS, Russell Crowther, on behalf of himself and approximately 42
other persons has appealed the decision of the Planning Commission to the City
Council; and
WHEREAS, on April 17, 1985, the City Council conducted a de novo public
hearing on the appeal, at whieh time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and o~al evidence presented to the City Council in support
of and in opposition to the appeal, and
WHEREAS, the City Council has further reviewed and considered the
Environmental Impact Report for the proposed subdivision,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on April 17, 1985, by a vote of 5-0, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
approval of SD-1567 by the Planning Commission was affirmed.
2. The Council determined that the tentative map was consistent with
the negotiated settlement agreement between the City and the
applicant dated May 31, 1981.
3. The conditions of the tentative map approval were modified as
follows:
(a) Access to the subdivision shall be provided for pedestrians and
bicyclists only at Kreisler Court. The pedestrian access
between lots 44 and 45 shall be deleted, as recommended by the
Planning Commission.

(b) Condition V-E, pertaining to the development fee for the
proposed fire station on the Seven Springs Ranch site, shall be
deleted.
4. The Council reserved, for determination at a later date, the selection
of options for the 2.3 acre park, as set forth in Condition VIII I.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 1st day of May, 1985,
by the following vote:
AYES: Councilmembers Clevenger, Hlava, MOyles and Mayor Fanelli
