RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA MODIFYING A DECISION OF THE PLANNING
COMMI~k~ON
WHEREAS, ERIC and LINDA PROTIVA, the applicants have applied to the
City of Saratoga for design review approval to construct a two-story single family
dwelling to be located at 14466 Oak Place, such application being identified as A-1069,
and
WHEREAS, on March 27, 1985, the Planning Commission conducted public
hearings on said application, and following the conclusion thereof, the Planning
Commission approved the application; and
WHEREAS, the applicants have appealed to the City Council the condition
imposed by the Planning Commission that the size of the structure be reduced to 2,380
square feet.
WHEREAS, on May 1, 1985, and July 3, 1985, the City Council conducted a
de novo public hearing on the appeal, at which time any person interested in the
matter was given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on July 3, 1985, by a vote of 4-1 with Councilmember Clevenger dissenting,
did resolve as follows:
1. The appeal from the Planning Commission was upheld and the
decision of the Planning Commission was modified as set forth below.
2. The size of the proposed structure shall not exceed 2,418 square feet,
as shown by the revised plans submitted by the applicant.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 17th day of July, 1985,
by the foliowing vote:
