RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
8AEATOGA UPHOLDING AND MODIFYING A DECISION OF
THE PLANNING COMMON
WHEREAS, JOHN CHU, the applicant, has applied to the City of Saratoga
for tentative map approval for a ten lot subdivision, such application being identified
as SD-1596, and
WHEREAS, on May 22, 1985, the Planning Commission conducted public
hearings on said application, and following the conclusion thereof, the Planning
Commission approved the application subject to a reduction in the number of lots from
ten to nine; and
WHEREAS, DALE DRUMM has appealed the decision oi the Planning
Commission to the City Council; and
WHEREAS, on June 19, 1985, and July 17, 1985, the City Council
conducted a de novo public hearing on the appeal, at which time any person interested
in the matter was given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on July 17, 1985, by a vote of 5-0 did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed and modified as
set forth below.
2. The number of lots shall be eight, with Lots 5, 6, 7, 8 and 9 being
reeonfigured into four lots as approved by the Director of Community
Development.
3. The residences constructed on Lots 1, 2, 3, 4 and 9 shall be single-
story, not exceeding eighteen feet in height.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 7th day of August,
1985, by the following vote:
AYES: Councilmembers Callon, Hlava, Moyles and Mayor Clevenger
