RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPHOLDING A DECISION OF THE PLANNING
COMMISSION
WHEREAS, on July 13, 1983, RALPH RENNA, the applicant, was granted a
variance to construct a masonry wall over six feet in height upon the property located
at 15041 Sobey Road, such application being identified as V-609; and
WHEREAS, as a condition of said variance, the applicant was required to
submit a lighting plan for review and approval by the Planning Commission, with the
stipulation that lights would be allowed only upon those sections of wall measuring 4 or
5 feet in height and no lighting would be allowed upon any portion of the wall which is
6 feet in height or greater, as measured on either side; and
WHEREAS, in accordance with the condition of said variance, the
application submitted a proposed lighting plan which was reviewed by the Planning
Commission at its regular meeting on June 26, 1985; and
WHEREAS, the lighting plan submitted by the applicant showed a total of
59 lights along the top of the wall, spaced at intervals of approximately twelve feet,
and included lighting on sections of the wall measuring 6 feet or greater in height; and
WHEREAS, the Planning Commission approved a modified lighting plan to
allow approximately 12 lights along the driveway walls in front of the property, spaced
at 24 foot intervals, conditioned upon the exterior side of the lights facing the
adjacent properties being blocked out and a variance being obtained for any portion of
the wall with the lights on top exceeding 6 feet in height; and
WHEREAS, the applicant has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on August 7, 1985, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports, and
the written and oral evidence presented to the City Council in support of and in
opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga at its
meeting on Augut 7, 1985, by a vote of three to zero with Councilmembers Fanelli and
Moyles absent, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.

2. The Council agreed with the determination by the Planning
Commission that the lighting proposed by the applicant was excessive
and that the lighting plan as submitted by the applicant did not
comply with the condition of the variance approval to the extent such
plan provided for the installation of lights upon sections of the wall
measuring 6 feet in height. It was further noted that in addition to
the lights along the perimeter walls which are the subject of the
lighting plan, the applicant has also installed at least 20 lights on the
house, lights on the cabana, and has wired an interior rear yard wall
for lighting.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 21st day of August,
1985, by the following vote:
