CITY OF SARATOGA FURTHER AMENDINe RESOLUTION NO. 85-9 AS AMENDED, ADJUSTING SALARIES ANO BENEFITS FOR NON-MANAGEMENT EMPLOYEES WHEREAS, the City of Saratoga, through its designated representatives and pursuant to State law, has met and conferred with the organized employee representative association, the Saratoga Employees Association (SEA), through its designated representatives, concerning proposals for modifications and changes to salaries, benefits and other matters; and WHEREAS, the representatives of the City and the SEA have reached an understanding regarding changes in salaries, benefits and other matters for the period September 1, 1994, through August 31, 1996, for employees represented by the SEA, all of which are specified in a Memorandum of Understanding dated June 21, 1995, which is attached hereto as Exhibit "A"; Exhibit "B" (Schedule of Salary Classes Effective March 1, 1995), and Exhibit "C" (Schedule of Salary Classes Effective December 1, 1995), attached hereto and incorporated by reference, provide the basis for rates of compensation to be paid the different positions in the City service. Applicability This resolution amends various Resolutions of the City of Saratoga. This resolution is an expression of existing policy of the City of Saratoga and is subject to modification and change by the City Council from time to time. Nothing herein contained shall be construed as creating or establishing any of the provisions hereof as terms of any contract of employment extending beyond a period other than such period as during the resolution is in full force and effect. That is to say, that any employee of the City of Saratoga during the effective period of the resolution shall have such employment rights and duties as set forth herein only during such period of time as this resolution remains in effect, and not afterward. NOW, THEREFORE, BE IT RESOLVED that the terms and conditions of the Memorandum of Understanding, dated June 21, 1995, are hereby approved. EXHIBIT "A" MEMORANDUM OF UNDERSTANDING ON WAGES, EMPLOYEE BENEFITS AND CONDITIONS OF EMPLOYMENT I. INTRODUCTION This Memorandum of Understanding is between the Management Negotiating Committee of the City of Saratoga, hereinafter referred to as "City" and the Saratoga Employees' Association, hereinafter referred to as "Association". The Memorandum of Understanding complies with the provisions of the Meyers-Milias-BrownAct of California, as contained in Section 3500, et seq, of the Government Code of the State in that the employer-employee representatives noted herein did meet in good faith and did reach an understanding on those matters within the scope of representation. This Memorandum of Understanding also complies with Resolution No. 509-2 relating to employer-employee relations, and Resolution No. 489-2, establishing the procedure for meeting and conferring with recognized employee organizations. II. GENERAL CONDITIONS A. Personnel Rules and Regulations This Memorandum of Understanding does not propose any modifications or change in the provisions of Resolution 85-9 of City, as .amended, unless a specific reference is made herein to a modification or addition to the conditions of these regulations. B. Terms of Understanding This Memorandum of Understanding embodies all modifications to salaries, hours, employee benefits and other terms and conditions of employment for the period beginning September 1, 1994, and continuing through August 31, 1996, at which time the Memorandum of Understanding terminates. C. Existing Benefits Continued This Memorandum of Understanding does not propose any modification to existing benefits contained in Resolution No 85-9, as amended, except as herein noted. D. City Council Approval City Council approval of the terms of the Memorandum of Understanding is incorporated in Resolution 85-9.100 which becomes effective on the date of the Memorandum of Understanding when passed by the City Council. III. SALARY ADJUSTMENTS Effective March 1{ 1995, all classified pay ranges and salaries will be i~Creased by 3% (three percent). Effective December 1, 1995, all classified pay ranges and salaries will be increased by 2% (two percent). IV. Eligibility for Overtime Pay Effective July 1, 1995, City agrees to include paid leave time taken within a pay period as time worked for purposes ~ calculating eligibility for overtime pay for all permanent non-management positions in the City service. V. Exempt Employees Under the Fair Labor Standards Act Association believes that at least some of the following non- management positions should not be classified as exempt from the requirements of the Fair Labor Standards Act: Accountant/Senior Accountant Administrative Analyst Administrative Secretary Assistant to the City Manager Assistant/Associate Engineer Assistant/AsSociate Planner Building Inspector Deputy City Clerk Plan Check Examiner/Plan Check Engineer Recreation Program Coordinator Recreation Supervisor Secretary to the City Manager Senior Engineering Technician Volunteer Coordinator Association agrees to submit a list of those positions it believes are not exempt with written justification stating the reasons that the position(s) are not exempt under the Fair Labor Standards Act regulations to City by June 30, 1995. City will review the data submitted, conduct its own review and issue a report on its findings to Association no later than October 1, 1995. If City determines that changes are required to meet Fair Labor Standards Act Regulations it will do so effective on October 1, 1995. VI. EMPLOYEE BENEFITS Association and City agree to the following adjustments to the benefits City provides the non-management employee classes in City service. A. Dental Coverage Effective July 1, 1995, City contribution to the dental plan will increase $5 (five dollars) per month per employee for a maximum of $45 (forty-five dollars) per month. Each employee (including the employee and employee's dependents shall receive 100% (one hundred percent) coverage of the first $270 (two hundred seventy dollars) of dental bills submitted in each six month period. 2 B. IRS Section 125 Benefit Plan During the term of this Memorandum of Understanding, City will pursue efforts to form an IRS Section 125 pool with other local agencies in an attempt to meet the minimum participation levels necessary to create such a plan. City agrees to contribute up to $1,000 (one thousand dollars) for set up costs of such a plan for employees. C. Health Insurance Effective July 1, 1995, City contribution to the benefit allowance shall increase $20 (twenty dollars) a month per employee for a maximum of $130 (one hundred thirty dollars) a month for any employee who declines to accept coverage in the health plan programby signing a waiver form. D. Mileage Allowance Effective July 1, 1995, the rate at which employees will be reimbursed for mileage for use of personal cars on City business shall be the rate set by the Internal Revenue Service for federal income tax calculation purposes. VII. SCOPE OF AGREEMENT This Memorandum of Understanding represents the entire and complete understanding reach between the representatives of the City of Saratoga and the representatives of the Saratoga Employees Association for the period designated and applies to all portions represented by the Saratoga Employees Association designated by the following classifications: Account Clerk, Accountant, Administrative Analyst, Administrative Secretary, Assistant Engineer, Assistant Planner, Assistant to the City Manager, Associate Engineer, Associate Planner, Building Inspector, Building Maintenance Custodian, Clerk Typist, Community Services Officer, Deputy City Clerk, Facilities Maintenance Leadworker, Irrigation Specialist, Japanese. Garden Caretaker, Japanese Garden Specialist, Parks Maintenance Leadworker, Parks and Landscape Maintenance Worker I, Parks and Landscape Maintenance Worker II, Plans Examiner, Plan Check Engineer, Public Services Assistant, Recreation Programs Coordinator, Recreation Supervisor, Secretary, Secretary to the City Manager, Senior Accountant, Senior Clerk Typist, Senior Engineering Technician, Street Maintenance Leadworker, Street Maintenance Worker I, Street Maintenance Worker II, Street Maintenance Specialist, Volunteer Coordinator. 3 VIII. RATIFICATION This Memorandum of Understanding is subject to ratification by a majority vote of the members of the Association. City Council adoption of Resolution No. 85- 9.100 and ratification by Association will put the terms of the Memorandum into effect. The City of Saratoga Employee's Association (SEA) and the City of Saratoga (City) are currently in the Meet and Confer process in an effort to agree on a successor Memorandum of Understanding (MOU) between the City and the SEA. The SEA has been informed by the City that the City Council is in the process of conducting a salary and compensation survey of several private sector businesses in Santa Clara County area. The City has advised the SEA that until such compensation survey is complete it is unable to adequately address proposals made by SEA that will or may have an economic impact on the City. Following discussions about the compensation survey and the Meet and Confer process the City and SEA have agreed to suspend current negotiations until the compensation survey is complete, and to extend the current agreement until a successor Agreement is reached. The City and SEA have further agreed that should the negotiations continue beyond August 31 or resume after August 31, 1994, any economic increases agreed upon shall be subject to retroactivity to September 1, 1994.
