RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPHOLDING A DECISION O1~ THE PLANNING
COMMISSION
WHEREAS, FRANK and MARIE SAUDE, the applicants, have applied to the
City of Saratoga for design review approval to construct a single family residence
upon the property located on Deer Springs Court, known as Lot 9 of Tract 6628, such
application being identified as A-1189, and
WHEREAS, on May 14, 1986, the Planning Commission of the City of
Saratoga conducted a public hearing on said application, and following the conclusion
thereof, the Planning Commission approved the application; and
WHEREAS, the applicants have appealed to the City Council a condition of
approval imposed by the Planning Commission that the total gross floor area for all
structures on the site be reduced from 7,8{10 square feet to 6,200 square feet; and
WHEREAS, the applicants submitted to the City Council a modified plan
showing a reduction of the total gross floor area of the structures on the site to 6,796
square feet; and
WHEREAS, on June 18, 1986, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council, including
the modified plan submitted by the applicants, and
WHEREAS, the matter was further considered by the City Council at its
regular meeting on July 2, 1986,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on July 2, 1986, by a vote of 3-2 with Councilmembers Moyles and Paterson
dissenting, did resolve as follows:
1. The appeal by the applicants from the condition of design review
approval requiring reduction of the gross floor area to 6,200 square feet was denied,
and the decision of the Planning Commission was affirmed.
2. The City Council found and determined that the increase in size
above the standard for the district, as requested by the applicants, would create
excessive bulk, particularly by reason of the style of the residence.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 16th day of July, 1986,
by the following vote:
AYES: Councilmembers Anderson, Cleve_nger, Moyles, Peterson, and Mayor Hlava
