HomeMy WebLinkAboutCity Council Resolution 2357 RESOLUTION NO: 2357 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, JOE WALLER and DAVID ZICOVICH, the applicants, have applied to the City of Saratoga for design review approval to construct a 247 square foot addition to a single family residence located at 14035 Saratoga Avenue, such application being identified as A-1198, and WHEREAS, on May 28, 1986, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, said property was sold by the applicants to Michael G. Rosa and Andrea T. Rosa, the appellants~ and WHEREAS, the appellants have appealed the decision of the Planning Commission to the City Council; and WHEREAS, the appellants submitted a revised drawing to the City Council providing for an addition of 120 square feet; and WHEREAS, on July 2, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council, in support of and in opposition to the appeal, including the modified plan submitted by the appellants, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on July 2, 1986, by a vote of 4-1 with Councilmember Peterson dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. Notwithstanding the modified plan submitted by the appellants, the City Council was still unable to make the finding required by the design review ordinance that the proposed addition will minimize the perception of excessive bulk and win be compatible in terms of height and bulk with other homes in the immediate vicinity. The site is substandard in size, consisting of only 5,276 net square feet in an R-I-20,000 zoning district. The original structure, without the addition, is 2,441) square feet, having been reduced to that size by the Planning Commission as a condition of the design review approval -1- granted by the Commission for such original structure. The site has therefore been fully developed with the existing structure and cannot reasonably accommodate any further additions thereto without creating excessive bulk. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 16th day of July, 1986, by the following vote: AYES: Counci]net~rs Anderson, Clevenger, MEryles, Peterson, and Mayor Hlava NOES: None ABSENT: None ABSTAIN: None ~~ ~_ ~ (1 _ ATTEST: CITY CLERK -2-
