HomeMy WebLinkAboutCity Council Resolution 2379 RESOLUTION NO. 23T3 · RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, CAROL BATSON, the applicant, has applied to the City of Saratoga for a second unit use permit for legalization of an existing second unit located upon the property at 187 I0 Aspesi Drive, such application being identified as SUP-86-00 1, and WHEREAS, on August 13, 1986, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, the applicant has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on September 17, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on September 17, 1986, by a vote of 5-0, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The City Council was unable to make the findings required for granting a second unit use permit by reason of the following considerations: (a) The lot is substandard in size and will not accommodate a detached second unit. (b) The proximity of the second unit to the property lines will cause adverse privacy impacts upon neighboring properties. (c) The design of the second unit is not compatible with the main dwelling on the site or with other structures in the immediate neighborhood. (d) The establishment of another off-street parking space will require excessive paving along the frontage of the property that will destroy the visual appearance of the site. -1- The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 1st day of October , 1986, by the following vote: AYES: Councilmenbets Anderson, Clevenger, Peterson and Mayor Hlava NOES: None ABSENT:Counci~ Moyles ~ ATTEST: CITY CLERK -2~
