RESOLUTION NO,
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA AMENDING THE GENERAL PLAN
LAND USE ELEMENT FOR A 5,682 SQ. FT. PORTION OF
LOT t. TRACT ?499, HERRIMAN AVENUE (APN 397-29-02)
WHEREAS. the City of SararoDe received an application from Osterlund
Enterprise5 to amend the General Plan Land Use Element DesiQnetion of a
3,GS2 sq. ft. parcel (APN 3B?-29-02) from Residential - Medium Density
SinOle Family <M-12.S) to Residential - Medium Density SinQle Fa~ilv <M-
10)~ and
WHEREAS, the City Council reviewed the neDafire declarationl and
WHEREAS, the City Council held a pubitc hearinQ on the proposed
amendment on October 5, 1986!
NOW, THEREFORE, BE tT RESOLVED, the City Council of the City of
Saratoga amende the Land U~e Element designation of a 3,GS2 ~q. ft. portion
of Lot I. Tract 7499, Herriman Ave. (APN 397-29-02> from Residential -
Medium Density Single Family (M-12.5) to Residential - Medium Density
SinGle Family (M-10) as shown on Exhibit "C". based on the ability to make
the findinq~ as stated in Exhibit "B".
The above and foreqolnO resolution was reQularly introduced and
thereafter passed and adopted by the SaratoQa City Council on the 1Sth day
of October. 198B, by the followinO vote:

FINDINGS
1. The General Plan Amendment is consistent with the polioies and
objectives of the General Plan.
2. The proposed General Plan Amendment will maintain the residential
character of the neighborhoods affeo!ed and will have no adverse
impact on the surround%nO area.
3. The proposed General Plan Amendment will not adversely affec~ the
pubtic safety, health and welfare or be ~a%eriatly injurious to
adjacent properties or i~prove~ents.
