RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
WHEREAS, a new State law has been enacted identified as AB 2187, ccrmonly
known as the '~Naters Bill," which modifies the regulations pertaining
to storage of hazardous materials; and
WHEREAS, the City has adopted a model form of hazardous materials ordinance,
as set forth in Chapter 8 of the City Code; and
WHEREAS, Section 3 of the Waters Bill, amending Section 25502 of the State
Health and Safety Code, provides that no City may assum~ responsibility
for implementation and enforcenent of the hazardous materials storage
regulations unless the City has adopted a resolution of self-designation
NOW, THEREFORE, THE CITY COLNCiL OF THE CITY OF SARAIOGA HEREBY RESOLVES
1. The City of Saratoga, acting by and through the City Council, hereby
assumes responsibility for the ~rmplementation and enforcen~mt of
the hazardous materials storage regulations as contained in Chapter
8 of the City Code, and as set forth in State law, to the extent
such State law is enforceable by the City.
2. The responsibility hereby assumed shall be delegated to the County
of Santa Clara pursuant to Section 8-05,020 of the Saratoga City
Code, until such time as the City Council shall, by resolution
or ordinance, rescind such delegation.
The above and foregoing resolution was passed and adopted at a regular
adjourned meeting of the Saratoga City Council held on the 29th day of
October, 1986, by the following vote:
