RESOLUTION OF TIiE CITY COUNCIL
OF THE CITY OF SARATOGA
UPHOLDING
A DECISION OF ~ PLANNING COMIISSION
WHEREAS, KAMIL NAVAI, the applicant, has applied to the City of Saratoga
for design review approval and use permit to construct 8 townhouses and a
retail commercial building on property located at 14599 Big Basin Way,
such application being identified as DR-87~052 and UP-87-Oll, and
WHEREAS, on July 22, t987 and August 26, 1987, the Planning Commission
of the City of Saratoga conducted a public hearing on said application, and
following the conclusion thereof, the Planning Commission approved the
application; and
WHEREAS, the Saratoga Village Association has appealed the decision of
the Planning Commission to the City Council on the ground that a larger por~
tion of the site should be devoted to retail commercial use; and
WHEREAS, on October 7, 1987, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council
in support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting
on October 7, 1987, by a vote of 5 - 0 did resolve as follows:
1. The appeal from the Planning Commission was denied and the deci-
sion of the Planning Commission was affirmed.
2. The Council found and determined that the portion of the site
devoted to retail commercial use (1,251 sq. ft.) should not be in~
creased for the following reasons:
(a) The site does not have sufficient area to comply with the
parking requirements for increased commercial usage.
(b) The site is long and narrow, having only an 80 foot frontage
on Big Basin Way. Consequently, a larger commercial
development would necessarily be constructed perpendicular
to the street, resulting in poor visibility of and access to
the retail establishments located therein.
(c) The proposal is consistent with earlier studies of the Vil-
lage area and the recently adopted conceptual Village Plan
which provide for a reduced intensity of commercial develop~
ment west of Fifth Street in order to establish a transi~
tional area between the Village and the adjacent residential
neighborhoods.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga on the 21st day of
October, 1987, by the following vote:
