RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA
UPHOLDING
A DECISION OF THE PLANNING CO!~ISSION
WHEREAS, DONALD S. BROWN, the applicant, has applied to the City of
Saratoga for design review approval to construct a onesstory single family
residence on property located at 14470 Oak Place, such application being iden~
tified as DR-87~043, and
WHEREAS, on June 10, 1987 and August 12, 1987, the Planning Commission
of the City of Saratoga conducted a public hearing on said application, and
following the conclusion thereof, the Planning Commission approved the
application; and
WHEREAS, C. HOLLY DAVIES has appealed the decision of the Planning Com~
mission to the City Council; and
WHEREAS, on October 7, 1987, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council
in support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting
on October 7, 1987, by a vote of 4 ~ 1 with councilmember Clevenger
dissenting, did resolve as follows:
I. The appeal from the Planning Commission was denied and the deci~
sion of the Planning Commission was affirmed.
2. The Council found and determined that the house has already been
reduced in size and height and a further reduction would not be
feasible or result in any material change in the bulk of the
structure or improvement of its design. The Council approved the
findings and conclusions of the Planning Commission and the Staff
Report dated August 12, 1987, and the same are incorporated herein
by reference.
3. An additional condition shall be added to the granting of design
review approval, to read as follows:
"Prior to issuance of a building permit, the applicant
shall submit a plan for approval by the City horticul-
turist showing measures to be taken for protection and
preservation of the existing oak tree in the rear yard
of the site."
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga on the 21st day of
October, 1987, by the following vote:
AYES: Councilmembers Anderson, Clevenger, Hlava, Moyles, and Mayor Peterson
