RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
SUPPORTING A LIMIT ON TRUCK OPERATIONS IN THE ROUTE 85 CORRIDOR
WHEREAS, Route 85/The West Valley Freeway goes through residential
neighborhoods, and
WHEREAS, in order to preserve the ambience of those neighborhoods, and
WHEREAS, an alternate freeway route for the use by commmercial
vehicles, which shall remain unrestricted by any local regulation as to
weight limits or types of vehicles, exists, and
WHEREAS, Section 35722 of the Vehicle Code allows the adoption of an
ordinance imposing a maximum gross weight limit of 9,000 pounds on
Route 85 from Interstate Route 280 in Cupertino south and east to
State Highway Route 101 in San Jose, with the approval of the
Department of Transportation., and
WHEREAS, any vehicles owned by a public utility will be able to
construct, operate, repair and maintain public utility facilities along
the West Valley Freeway.
NOW, THEREFORE, BE IT RESOLVED, that the City of Saratoga supports the
limit of 9,000 pounds for any motor vehicle (other than passenger
buses, recreational vehicles, and utility vehicles with business along
the corridor) within its jurisdiction.
BE IT FURTHER RESOLVED that the City of Saratoga encourages the
adoption of a similar ordinance in each jurisdiction along the West
Valley Corridor and encourages the Board of Supervisors of Santa Clara
County to submit a proposed ordinance to the Department of
Transportation for approval.
BE IT FURTHER RESOLVED that Routes 17, 101 and 280 are hereby
designated as alternative routes for the use of such motor vehicles as
are prohibited the use of the West Valley Freeway, which alternate
routes shall remain unrestricted by any local regulation as to weight
limit or type of vehicle so long as this ordinance remains in effect.
The above and foregoing resolution was passed and adopted by the
Saratoga City Council at a meeting held on the 20th day of January,
1988, by the following vote:
