HomeMy WebLinkAboutCity Council Resolution 2504 RESOLUTION NO. 2504 RESOLUTION OF T~ CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, Saratoga Partners, the applicant, has applied to the City of Saratoga for tentative map approval for a 12 lot subdivision, design review approval of two single story retail buildings, use permit and design review approval of a 10 unit townhouse development, on a commercially zoned site located at the southeast corner of Saratoga/Sunnyvale Road and Cox Avenue, such applications being identified respectively as SD-87-019, DR-87-123, UP-87-017 and DR-87-124, and WHEREAS, on April 19, 1988, and June 8, 1988, the Planning Commission of the City of Saratoga conducted a public hearing on said applications~ and following the conclusion thereof, the Planning Commission denied each application; and WHEREAS, the applicant has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on July 6, 1988, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said applications, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on July 6, 1988, by a vote of 4-1 with councilmember Peterson dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The Council concurred with the determinations by the Planning Commission that the proposed development of both the commercial and residential portions of the site was too dense, that the retail building at the corner of Saratoga/Sunnyvale Road and Cox Avenue created adverse visual and safety impacts, that the driveway access on Saratoga/Sunnyvale Road created a potential safety problem, and that the townhouses along the eastern side of the property created adverse impacts upon the views and privacy of the owners of adjacent residential properties. 3. The applicant will be allowed to submit a revised proposal, for consideration by the Planning Commission, provided such revised proposal complies with the following requirements: -1- (a) The corner retail building shall be eliminated. The remaining retail building on the site can be enlarged to compensate for ....... the loss of retail space, but it is the desire of the Council to avoid the placement of a structure directly at the corner. (b) The number of townhouses shall be reduced from 10 to 8. The additional space resulting from such reduction shall be utilized for parking and recreation areas.
