HomeMy WebLinkAboutCity Council Resolution 2534 ~LtH'IONNO.: 2534 RESOLUTION OP THE CITY COUNCIL OF THE CITY Olv SARATOGA UPHOLDING A DECL~ION Ol~ THE PLANNING COMMISSION WHEREAS, DANIEL and HELENA LECKRONE, the applicants, have applied to the City of Saratoga for design review approval to construct a second story addition to an existing residence located at 19521 Douglass Lane, such application being identified as DR-88-079, and WHEREAS, on October 26, 1988, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission approved the application; and WHEREAS, Mary Ann Welch and 5150 Homeowners Association have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on December 7, 1988, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on December 7, 1988, by a vote of 4-0 with Councilmember Moyles absent, did resolve as follows: 1. The appeal from the decision of the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The City Council was able to make all of the findings required for granting design review approval on this application, for the same reasons as set forth in Resolution No. DR-88-079 adopted by the Planning Commission on October 26, 1988, and such Resolution is incorporated herein by reference. The Council noted in particular that: (a) Other two story homes are located within the neighborhood. (b) The second story addition proposed by the applicants will be separated from the adjacent Welch residence by a distance of approximately 2{)0 feet and wilt be screened by landscaping, thereby avoiding unreasonable impacts on views or privacy. 3. The City Council modified the condition number 3, concerning installation of additional landscaping, to specifically require that -1- such landscaping be non-deciduous in nature, as approved by the Planning Director. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 21st day of December, 1988, by the following vote: AYES: Councilmembers Clevenger, Moyles, Peterson and Mayor Anderson NOES: None ABSENT: Colmci~ Stutzman ATTEST: -2-
