RESOLUTION OF THE CITY COUNCIL OF THE
CITY O1~ SARATOGA REVERSING A DECISION OF
THE PLANNING COMMISSION
WHEREAS, GEORGE and ELLEN PIERCE, the applicants, have applied to
the City of Saratoga for subdivision approval to divide the property located at 14584
Horseshoe Drive into two lots, such application being identified as SD-88-015, and
~HEREAS, on December 14, 1988, and January 25, 1989, the Planning
Commission of the City of Saratoga conducted a public hearing on said applications,
and following the conclusion thereof, the Planning Commission approved the
applications; and
.WHEREAS, a group of neighboring property owners has appealed the
decision of the Planning Commission to the City Council; and
WHEREAS, on March 1, 1989, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
· ' ' ral evidence presented to the City Council in support
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on March 1, 1989, by a vote of 4-1 with Councilmember Peterson dissenting,
did resolve as follows:
1. The appeal from the Planning Commission was upheld and the
decision of the Planning Commission was reversed.
2. The City Council found and determined as follows:
(a) The creation of an additional lot will result in more than four
sites taking access from Horseshoe Court, which is a minimum
access street. This would violate Section 14-25.030(g) of the
City's Subdivision Ordinance.
(b) The widening of Horseshoe Court to a full-size city street
would result in substantial environmental damage and destroy
the rural character of the neighborhood.
(c) An additional lot utilizing Horseshoe Court as a means of
access will unreasonably increase the traffic hazards on this
particular street, as it presently exists. Consequently, the
granting of an exception to the design requirements of the
Subdivision Ordinance would be materially detrimental to the
public safety and injurious to other properties in the vicinity of

this site. Moreover, no special circumstances have been shown
to justify such an exception.
(d) The applicants' property is unsuitable for further development
by reason of drainage problems, excessive removal of existing
vegetation, and possible unavailability of sewer facilities.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 15th day of
March 1989, by the following vote:
