Home My WebLink AboutCity Council Resolution 2570 RESOLUTION NO,: 2570 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECRtlON OF THE PLANNING CONM~$ION WHEREAS, LYNN SHANNON, D.V.M., and EDWIN WIESER, D,V.M., the applicants, have applied to the City of Saratoga for a use permit to operate a veterinary hospital at the Saratoga Oaks Shopping Center located at 12840 Saratoga- Sunnyvale Road, and WHEREAS, on February 22, 1989, and March 8, 1989, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission approved the application; and WHEREAS, Jerome Kocir has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on April 19, 1989, the City Council conducted a de novo review on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on April 19, 1989, by a vote of 4-1 with Councilmember Stutzman dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The City Council was able to make the findings required for granting the use permit by reason of the conditions of approval imposed by the Planning Commission, which will serve to mitigate potential adverse impacts and provide oversight through a scheduled review of the use permit after one year. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 3rd day of May, 1989, by the foilowing vote: AYES: Councilmentors Clevenger, Moyles, Peterson, Stutzman, and ~ayor Anderson NOES: None ABSENT: None ,/ ATTEST:
