WHEREAS, a subdivision map for that certain property located in the City
of Saratoga, County of Santa Clara, State of California, identified as Tract No. 6665
was recorded in the office of the Santa Clara County Recorder on August 7, 198 1, in
Book 488 of Maps, at Pages 40 through 45; and
WHEREAS, said map contained an offer of dedication to the public of the
streets shown thereon, which offer was rejected at the time the map was recorded;
and
WHEREAS, as of May 12, 1989, all of the streets shown said subdivision
map had been completed and maintained by the subdivider for a period of one year
,(following the date of satisfactory eompleiion of construction; and
~1~ WHEREAS, the City of Saratoga now desires to partially accept the offer
I3~of dedication contained in said map,
NOW THEREFORE, be it resolved by the City Council of the City of
h. Saratoga as follows:
1. The offer of dedication to the public of the streets shown on the
~ subdivision map for Tract 6665, as recorded on August V, 1981, in Book 488 of Maps,
r.~ Pages 40-45, is hereby accepted as to Saratoga Heights Road only and said road is
hereby declared to be a public street of the City of Saratoga. The offer of dedication
shall continue to be rejected as to all remaining streets shown on said map.
2. The improvement bonds issued to the City of Saratoga by Developers
Insurance Co., identified as Bond Nos. 103333, 103335 and 103341, each dated August
24, 198 1, are hereby released and may be cancelled.
3. This Resolution supersedes and cancels Resolution Nos. 36-B-235 and
36-B-236 adopted by the City Council on June 7, 1989, and such Resolutions are hereby
declared to be void and of no force or effect.
