EESOLUTIOM OF THE CrrY COUNCIL OF THE
CITY OF SARATOGA UPHOLDIHG A DECI~IOH OF
THE PLANHING COMMItION
WHEREAS, the IOOF Home of California, the applicant, has applied to the
City of Saratoga for a use permit to allow certain outside groups to use the exterior
grounds for picnics, such application being identified as UP-89-003, and
WHEREAS, on June 14, 1989, the Planning Commission of the City of
Saratoga conducted a public hearing on said application, and following the conclusion
thereof, the Planning Commission approved the application as modified and subject to
various conditions; and
WHEREAS, Jeffrey Schwartz has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on August 2, 1989, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
applications, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on August 2, 1989, by a vote of 5-0 did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed and modified as
set forth below.
2. The picnics by outside groups shall be limited to those scheduled for
August 6th, 17th, 19th, 25th and 27th. No other picnics conducted by
outside groups shall be allowed.
3. Except for the provisions concerning frequency and days of the week,
the picnics shall be conducted in accordance with the administrative
rules, as previously adopted by the City Council.
4. No amplified sound shah be allowed.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Couneil of the City of Saratoga held on the 6~h day of
Sep~ , 1989, by the following vote:
AYES: Councilmembers Anderson, ~Dyles, Stutm~an and Mayor Clevenger
NOES: None
ABSENT:Councilmember Peterson
