RESOLUTION OF THE CITY COUNCIL OF TI-IE

MODIFYING A DECISION OF THE PLANNING
COMks!sSION
WHEREAS, SAM ESPESETH, the applicant has applied to the City of
Saratoga for a lot line adjustment and building site approval involving two existing lots
of record located at 2027 1 Metrick Drive, such applications being identified as LL-89-
003 and SD-89-005, and
WHEREAS, on June 14, 1989, the Planning Commission of the City of
Saratoga conducted a public hearing on said applications, and following the conclusion
thereof, the Planning Commission approved the applications; and
WHEREAS, Lea Wilson, Don Murphy and Barbara Seacrist have appealed
the decision of the Planning Commission to the City Council; and
WHEREAS, on August 2, 1989, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on August 2, 1989, by a vote of 3-2 with Councilmembers Anderson and
Stutzman dissenting, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed and modified as
set forth below.
2. The City Council was able to make all of the findings required for the
granting of the lot line adjustment and building site approval, based
upon the following considerations:
(a) Two legal lots of record presently exist.
(b) If the existing dwelling unit is partially or totally demolished so
as to eliminate the encroachment on Lot B, a new dwelling can
be constructed on Lot B which would be more impactful to the
surrounding properties.
(c) Each of the existing lots is less than one acre in size. There are
no open space dedications on the property or other restrictions
against development. Consequently, the open space policies of
the General Plan will not be violated by the lot line adjustment
and building site approval. With Parcel B reduced in size to
10,019 square feet, a smaller home will be constructed on this
lot which will be more compatible with the neighborhood and
also will result in the preservation of more open space on
Parcel A.
3. The conditions of building site approval, as set forth in Resolution
3D-89-005, adopted by the Planning Commission on June 28, 1989,
are modified as follows:
(a) Condition 3 is amended to read:
'tinstall a standard paved driveway for both lots. Driveways
shall have a 14 foot minimum width plus 1 foot shoulders."
(b) Condition 4 is amended to read:
"The driveway to serve as access to the existing residence shall
be located as far west on the access corridor as possible. The
area between the driveway and the Wilson property shall be
landscaped with evergreen trees and shrubs of sufficient size
and number to adequately screen the driveway. A landscape
plan shah be submitted to the Planning Director for approval
and landscaping shah be installed prior to occupancy of the new
residence on Pereel A."
(c) A new condition 7 is added, to read as follows:
"7. Drainage plans for both lots shall be furnished and approved
by the City Engineer prior to issuance of any building permit."
......... ' ........ (d) A new condition 8 is added, to read as follows:
"8. To the extent possible under the City's grading, drainage
and design review standards, the new residence on Parcel A
shall be constructed at the same pad elevation as the residences
on Merriek Drive adjacent to the site."
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 6th day of September,
1989, by the following vote:
