RESOLUTION OF THE CITY COUNCIL Of THE
CITY OF SARATOGA UPHOLDING A DECISION OF
THE PLANNING COMMON
WHEREAS, DAVID YOUNG and NIKKI YOUNG, the applicants, have
applied to the City of Saratoga for design review approval to reconstruct a single
family residence upon the p~operty located at 15185 Pepper Lane, such applieation
being identified as DR-89-076, and
WHEREAS, on September 13, 1989, and September 27, 1989, the Planning
Commission of the City of Saratoga conducted a public hearing on said application,
and following the conclusion thereof, the Planning Commission approved the
application; and
WHEREAS, James and Franeia Hyland have appealed the decision of the
Planning Commission to the City Council; and
WHEREAS, on November 1, 1989, the City Council conducted a de novo
public hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on November 1, 1989, by a vote of 3-2 with Councilmembers Anderson and
Stutzman dissenting, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed and modified as
set forth below.
2. The City Council was able to make the design review findings for the
reasons described in the Staff Report dated September 18, 1989, and
set forth in Resolution No. DR-89-076 adopted by the Planning
Commission on September 13, 1989, and the same are incorporated
herein by reference.
3. The conditions imposed by the Planning Commission are modified as
follows:
(a) Condition No. 11 concerning removal of the 2 small oak trees
along the west side of the proposed residence shall be deleted
and no requirement shall be imposed for removal of such trees.
(b) The conditions added by the Planning Commission for removal
of a window in bedroom 3 and limitation on the days and hours
of construction activity are both deleted.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 15th day of November,
1989, by the following vote:
AYES: Council members Anderson., Moyles, Peterson, Stutzman and Mayor Clevenger
