RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF 8ABATOGA MODIFYING A DECISION OF
THE PLANNING COM_M!SS_ION
WHEREAS, SAM ESPESETH, the applicant, has applied to the City of
Saratoga for design review approval to construct a new single family residence upon
the property located at 2027 1 Merrick Drive, such application being identified as DR-
89-105, and
WHEREAS, on September 27, 1989, the Planning Commission of the City of
Saratoga conducted a public hearing on said application, and following the conclusion
thereof, the Planning Commission approved the application; and
WHEREAS, Barbara Kenrich has appealed the decision of the Planning
Commission to the City Council requesting certain modifications to the design with
respect to fencing and landscaping; and
WHEREAS, on November 1, 1989, the City Council conducted a de novo
public hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on November 1, 1989, by a vote of 5-0 did resolve as follows:
1. The appeal from the Planning Commission was upheld and the
decision of the Planning Commission was modified as set forth below.
2. The design review approval is modified as follows:
(a) The material for the fence to be installed along the northern
and eastern property lines of the site shall be wood instead of
chain link, with landscaping to screen such fence, to be
installed in accordance with a landscape plan approved by the
Planning Director.
(b) 15 gallon pittosporium shrubs shall be planted adjacent to the
fence on the Wilson property line, as shown on the landscape
plan, but only for a distance of 2D feet past the bend in the
direction of the fence along the northwestern property line of
the Wilson site. At least twelve 24" box trees shall additionally
be planted along such northwestern property line, the species
and location of which shall be approved by the Planning
Director. The landscaping required herein shall be installed
within 6 weeks from the adoption of this Resolution, subject to
reasonable delays caused by unavailability of plant material.

(e) The driveway of the new residence shall be concrete, brick,
pavin~ stones or comparable material as approved by the
Planning Director. No asphalt shall be used for such driveway.
(d) The first 30 feet in length from the street of the driveway
servicing the existing residence shalZ be concrete, brick, paving
stones or comparable material as approved by the Planning
Director, but the bahnee of such driveway may be asphalt.
(e) As required by the approval ~Tanted for the lot line adjustment
between Parcel A and Pareel B, the drainage from both parcels
shall be eolZeeted and diverted to approved drainage facilities
on Metrick Drive.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Couneil of the City of Saratoga held on the 15th day of November,
1989, by the following vote:
