KESOLUTION OF THE CITY COUNCIL OF THE
CITY OF S~%TOGA UPHOLDING A DECISION OF
THE PLANMI~G COMMI~MION
WHEREAS, EMMETT CASHIN, the applicant, has applied to the City of
Saratoga for design review approval to renovate the Blue Hills Center located at 12029
Saratoga/Sunnyvale Road and variance approval to allow a free standing sign, such
applieation being identified as V-89-039, and
WHEREAS, on November 8, 1989, the Planning Commission of the City of
Saratoga eondueted a public hearing on said application, and following the conclusion
thereof, the Planning Commission approved the applieation including approval of a sign
program for the shopping center; and
WHEREAS, Ken Nader, one of the tenants at said premises, has appealed
the decision of the Planning Commission to the City Counei] on the ground that the
approved sign prodTam does not provide appellant with sufficient signage for his
business; and
WHEREAS, on December 20, 1989, the City Council conducted a de novo
public hearing on the appeal, at whieh time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and eonsidered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga at its
meeting on Deeember 20, 1989, by a vote of 5-0, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.
2. The appellant was advised to submit an applieation for approval by
the Planning Commission of the specific signs desired by appellant.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 3rd day of January,
1990, by the following vote:
AYES: Councils Anders~n, MDyles, Peterson, Stutzman and Mayor Clevenger
