HomeMy WebLinkAboutCity Council Resolution 2637 RESOLUTION NO: 2637 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA REVERSING A DECISION OF THE PIANNING COMMISSION WHEREAS, JEFFREY HORNUNG and CYNTHIA McCULLEY, the applicants, have applied to the City of Saratoga for a variance to allow construction of an addition to the single family residence located at 18651 Perego Way having a 6-foot side yard setback where 10 feet is required, such application being identified as V-89-042, and WHEREAS, on January 10, 1990, the Planning Commission of the City of Saratoga, conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, the applicants have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on February21, 1990, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on February 21, 1990, by a vote of 3-0 with Councilmembers Moyles and Anderson absent, did resolve as follows: 1. The appeal from the Planning Commission was upheld and the decision of the Planning Commission was reversed. 2. The City Council was able to make the findings required for granting the variance for the reasons set forth in the Staff Report to the Planning Commission, dated January 10, 1990, as such report is incorporated herein by reference. 3. The variance was granted subject to the following additional conditions: (a) The windows along the west side of the house shall be flush with the exterior wall. -1- (b) The skylight to be installed in the kitchen ceiling shall have obscure glass, as approved by the Planning Director, in order to mitigate any glare upon the adjacent property.
