HomeMy WebLinkAboutCity Council Resolution 2646 RESOLUTION NO 2646 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA REVERSING A DECISION OF THE PLANNING COMMISSION WHEREAS, David and Susan Levin, the applicants, have applied to the City of Saratoga for design review approval to remodel an existing single family residence located at 18851 Ansley Place, such application being identified as DR-89-124; and WHEREAS, on February 14, 1990 the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, the applicants have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on April 4, 1990, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given the opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission relating to said application, and written and oral evidence presented to the City Council in support of and in opposition to the appeal; and NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting of April 4, 1990, by a vote of 4-0 with Councilmem- ber Peterson absent, did resolve as follows: SECTION 1: The appeal from the Planning Commission was upheld and the decision of the Planning Commission was reversed. SECTION 2: The City Council found and determined that: (a) The height, elevation and placement of the project on the site does not unreasonably interfere with views of the surrounding residences in that the proposed second story addition is located adjacent to dense, mature landscaping on the side property line and additional landscaping will be required on the rear property line. (b) The project does not unreasonably interfere with the privacy of the surrounding residences in that the upper story windows are either translucent or located to not allow views onto neighboring properties. (c) The natural landscape is being preserved by minimizing tree removal, soil removal, and grade changes in that 1 no grade changes are proposed and no vegetation will be removed. (d) The project will minimize the perception of excessive bulk in relation to the immediate neighborhood in that the second story addition is a maximum of 21.5 feet high and maintains the ranch style characteristics of the neighborhood by employing hip roofs and compatible exterior materials. (e) The project is compatible in terms of bulk and height with those homes within the immediate area and in the same zoning district in that there are two story struc- tures within close proximity of the proposal and that two story homes are common within this zone district, R-l-10,000. (f) The project will not interfere with the light, air and solar access of adjacent properties in that the addi- tion meets minimum setbacks, the second story is inset from the ground floor and does not adversely impact the adjacent homes. (g) The plan does incorporate current Saratoga grading and erosion control standards in that no grading is pro- posed and a drainage plan will be submitted to the Building Division. SECTION 3. After careful consideration of the site plan, architectural drawings, plans and other exhibits submitted in connection with this matter, the design review application of DR. and Mrs. David Levin for design review approval be and the same is hereby granted subject to the following conditions: a. The development shall be located and constructed as shown on Exhibit "A", incorporated by reference. b. Prior to submittal for building permit or grading permit, a zone clearance shall be obtained from the Planning Department. c. Height of structure shall not exceed 21.5 feet. d. Total gross floor area for all structures on site shall not exceed 3367 sq. ft. e. No ordinance size tree shall be removed without first obtaining a Tree Removal Permit. f. Obscure glass or clerestory windows shall be used on the second story windows as shown on Exhibit "A" to mitigate privacy concerns. g. Exterior colors and materials shall to match existing resi- dence subject to staff review and approval. h. Prior to zone clearance approval, applicant shall submit landscape plans subject to Planning Director review and approval. The landscape plan shall show a minimum of 2-24" evergreen trees located adjacent to the rear property line to enhance the privacy between the second story addition and adjacent neighbors. Landscaping shall be installed and inspected by the Planning Department prior to final building inspection. i. Driveways: All driveways have a 14 ft. minimum width plus one ft. shoulders. j. The applicants shall secure the review and approval of proposed construction plans by Central Fire District prior to issuance of a zone clearance Section 4. Applicant shall sign the agreement to these conditions within 30 days of the passage of this resolution or said resolution shall be void. Section 5. Construction must be commenced within 24 months or approval will expire. Section 6. All applicable requirements of the State, County, City and other Governmental entities must be met. Section 7. The applicant shall affix a copy of this resolution to each set of construction plans which will be sub- mitted to the Building Division when applying for a building permit.
