RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
REGARDING THE FORMATION OF A CONGESTION MANAGEMENT
PLANNING AGENCY FOR SANTA CLARA COUNTY
WHEREAS, the State of California enacted into law AB 471 (Katz),
Chapter 106, July 10, 1989, and SB 300 (Kopp), Chapter 105, July
10, 1989, and AB 1791 (Katz}, Chapter 16, March 12, 1990, which,
upon the passage of Proposition 111 on June 5, 1990, requires the
development, adoption, implementation and enforcement of a coun-
ty-wide Congestion Management Plan and the designation cf an
overseeing Congestion Management Planning Agency for the develop-
ment of a long-term, comprehensive transportation program; and
WHEREAS, eligibility for over $600 million in transportation
funding for Santa Clara County and its cities is dependent on
passage of Proposition 111 and the designation of a Congestion
Management Planning Agency, and' conformance to a Congestion
Management Plan; and
WHEREAS, in order to meet the requirements of the State iegisla-
tion and to be eligible for new transportation funding, the
Cities and the County have expressed an interest in creating a
CMP Agency if the California voters approve Proposition 111; and
WHEREAS, the Cities and the County have reviewed, discussed and
worked cooperatively with a broad-based consensus to develop a
proposal for the creation of a CMP Agency;
NOW, THEREFORE, be it resolved that the City of Saratoga agrees
to participate in the Congestion Management Planning Agency as
set forth in Attachment A, upon the passage of Proposition 111~
provided that an additional paragraph to Section 3 of Attachment
A be added to read as follows~ "15. Provide technical assistance
requested by individual jurisdictions to facilitate development
of local policies and programs to effectively implement adopted
CMP and TDM requirements."
The above and foregoing resolution was passed and adopted at a
regular meeting of the Saratoga City Council held on the t6th day
of May, 1990, by the following vote:
AYES: Councilmembers Anderson, Moyles, Peterson, Stutzman and Mayor Cle~e_nger
