RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA
MODIFYING A DECISION OF THE PLANNING COMMI8SION
WHEREAS, JOSEPH GUILARDI, the applicant, has applied to
the City of Saratoga for design review approval to construct an
addition to the existing residence located at 15410 Pepper Lane,
such application being identified as DR-89-106, and
WHEREAS, on January 10, 1990, and February 14, 1990, the
Planning Commission of the City of Saratoga, conducted a public
hearing on said application, and following the conclusion thereof,
the Planning Commission approved the application subject to various
conditions, including conditions requiring certain modifications to
the original design of the project; and
WHEREAS, the applicant has appealed to the City Council
four of the changes to the project required by the Planning
Commission; and
WHEREAS, on May 2, 1990, the City Council conducted a de
novo public hearing on the appeal, at which time any person
interested in the matter was given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the
staff reports, minutes of the proceedings conducted by the Planning
Commission relating to said application, and the written and oral
evidence presented to the City Council in support of and in
opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga,
at its meeting on May 2, 1990, by a vote of 4-0 with Councilmember
Stutzman absent, did resolve as follows:
1. The appeal from the Planning Commission was upheld
in part and the decision of the Planning Commission
was modified as set forth below.
2. With respect to the modifications to the project
required by the Planning Commission, the City
Council determined as follows:
( a ) The condition for reduction of the porte
cochere from a 26 foot width to a 17 foot
width is reversed and the porte cochere may be
constructed as originally designed at 26 feet
affirming the Planning Commission condition

that the columns shall be wood material rather
than stone.
(b) The condition for the bathroom window on the
second story north elevation to be obscure
glass is affirmed.
(c) The condition for reduction of the second
story balcony to a maximum width of 7 feet is
modified to allow such balcony to be
constructed to a maximum width of 10 feet.
(d) The condition for installation of landscaping
is modified to eliminate only the additional
landscaping at the north property line and
substitute in place thereof a requirement that
the second story bedroom windows on the north
elevation shall be clerestory. All other
landscaping shall be installed as required by
the Planning Commission, including the
additional landscaping along the front and
south property lines and planting of vines
around the columns of the porte cochere.
3. Except as-herein modified, all of the conditions
and requirements established by the Planning
Commission, as set forth in Resolution No. DR-89-
106 adopted by the Planning Commission on March 14,
1990, are affirmed, incorporated herein by
reference, and declared to be in full force and
effect.
The above and foregoing resolution was passed and adopted
at a regular meeting of the City Council of the City of Saratoga
held on the 16th day of May, 1990, by the following vote:
