HomeMy WebLinkAboutCity Council Resolution 2657 RESOLUTION NO= 2657 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, GEORGE PIERCE and JOSEPH WALLER, the applicants, have applied to the City of Saratoga for tentative map approval to divide the property located at 14585 Horseshoe Drive into two lots, such application being identified as SD-89-017, and WHEREAS, on February l4, 1990, the Planning Commission of the City of Saratoga, conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, the applicants have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on May 16, 1990, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on May 16, 1990, by a vote of 5-0, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The Council agreed with the determinations of the Planning Commission that: (a) The site is not physically suitable for the type of development because of drainage problems caused by an existing natural swale, potential erosion from the increased impervious coverage, and damage to the natural terrain that would be caused by the removal of trees and other vegetation and grading of the site. (b) The site is not physically suitable for the -1- proposed density of development because the proposed 1/2 acre flag lot is not compatible with either existing parcels on Horseshoe Drive or the larger parcels on Horseshoe Court. Although the property has an R-1- 20,000 zoning classification, it is actually located within an R-1-40,000 neighborhood. The foregoing considerations are discussed in more detail in the Staff Report to the Planning Commission dated February 14, 1990, and such Report is incorporated herein by reference. The above and foregoing resolution was passed and adopted at a regular meeting of the Cit~Council of the City of Saratoga held on the 6th day of J~e!~, 1990, by the following vote: AYES: Councilmembers Anderson, Moyles, Peterson, Stutzman and Mayor Clevenger NOES: None ABSENT: None Mayor / City Clerk ~ -2-
